A staggering 36 million people have voted early, setting the stage for big midterm turnout

The turnout could be a source of error in pre-election surveys if pollsters did not calibrate properly for such high rates of voting.

A staggering 36 million voters cast their ballots ahead of Election Day this year, setting the stage for much-higher-than-usual turnout for a midterm — and, potentially, big surprises on Tuesday night.

Republican enthusiasm for President Donald Trump and Democrats’ itch to repudiate him at the ballot box have driven people to the polls far faster than in 2014, when 27.2 million people voted early, according to Michael McDonald, a University of Florida professor who tracks voter turnout.

And that trend is expected to extend into Election Day. Early voters in three states — Texas, Nevada and Arizona — have already surpassed total turnout in the last midterm election, McDonald’s data shows, and more states will blow past their normal non-presidential turnout with just a handful more votes on Election Day. The high voting rates have transformed expectations about who will show up in the midterms — and they could inspire results that diverge from any pre-election polls that did not reckon with this year’s unusually high enthusiasm.

“This is not a normal election,” McDonald told POLITICO. “The best guess is that we’re looking at some sort of hybrid midterm/presidential election” in terms of turnout.

Analysts cautioned against drawing broad conclusions about which party could gain an advantage from the high early vote totals. But they did note that pre-election polls make built-in assumptions about how many people will vote, and pollsters who leaned too heavily on past midterm turnout may have misfired.

McDonald and the team at Edison Media Research, which is conducting a revamped exit poll this election after stumbling in 2016, predict that 105.5 million people will vote this year — about 45 percent of the voting eligible population. That’s up from 2014, an unusually low-turnout year in which fewer than 82 million people voted for the highest office on their ballot, but still lower than 2016, when about 137 million people voted for president.

“I think we’ve all made a very safe assumption that 2018 will look nothing like 2014,” Bonier said, noting that underestimating certain demographics by even a few percentage points in a poll could have an outsized effects on the results.

Some pollsters, like Monmouth University and the New York Times/Siena College, have adjusted this year by publishing multiple results for each poll, detailing how the results would change under different turnout scenarios. And the baseline estimates have gone up in recent weeks: The first Times/Siena poll of Rep. Pete Sessions’ (R-Texas) contested reelection race, for example, projected that about 194,000 people would turn out, while the second poll projected 211,000 voters would cast ballots in that slice of the Dallas suburbs.

Over 188,000 voters have already cast early ballots in the Dallas County portion of the battleground district, according to county data. (Another 7 percent of the district’s population is in another county that has not published early vote totals by congressional seat.)

Higher-than-expected turnout helped Democrats in some but not all of the Times/Siena polling models.

Mara Suttmann, a professor of government at Connecticut College, noted that it’s hard to predict which party will benefit from early voting because many voters would have voted whether or not early voting was an option — “cannibalizing” the Election Day vote instead of adding many new voters to the electorate.

Bonier noted that there has been in a surge in non-usual voters, including young people and people voting for the first time, which could favor Democrats. But even this does not guarantee electoral success for Democrats on Tuesday.

“The open question that won’t be answered until [results are in]: Do those early vote trends carry on through Election Day?” Bonier asked. “Or are they reversed? In 2016, in a lot of cases, they were reversed. I don’t think you can bet one way or another at this point.”

These low-propensity voters still make up a proportionally small portion of both the early voter electorate and the expected overall electorate. Data from TargetSmart shows that early voters younger than 39 are still easily outnumbered by voters aged 50-64, and even more so by voters over the age of 65.

And even in states where Democrats lead Republicans in early ballots cast — like Florida, where there’s a tight gubernatorial and Senate election — the election is still far from over.

And there’s still a likely majority of votes to be cast on Election Day.

“We may see another 60 million votes cast [on Election Day]. Most people who will have ended up voting in this election have still not voted,” Bonier said. “In the end, what happens on Election Day turnout will, to some extent, swamp what happened in the early vote.”

LOUISVILLE, Ky. (AP) — Michael Gregoire marched along a downtown sidewalk in the tense days before the midterm elections, waving a hand-painted sign at passing traffic: “DEFEAT REPUBLICANS 2018.”

“The survival of the country is going to depend on this election,” he said as another man stopped for a moment to argue. The strangers faced each other from opposite edges of the great American divide, Democrat versus Republican, both convinced the election is among the most consequential in their lifetimes and that they must save the nation from the other side.

President Donald Trump looms large over Tuesday’s election, which is expected to draw historic numbers to the polls and will determine which party controls Congress. For Gregoire and Kanter — and for voters across the country — the election represents something far greater than whatever Senate and House races appear on their ballots. It is a competition for the soul of America — a referendum on Trump and the venomous political culture that many blame for gridlock in Congress and a recent spate of hate crimes and politically motivated attacks.

Less than two weeks ago in this city, a white man gunned down two African-American shoppers at a grocery store in what police described as a racially motivated attack. Days later, an avid Trump supporter was arrested for mailing pipe bombs to prominent critics of the president, all of whom Trump routinely derides as “evil” and “un-American.” The next day, another gunman opened fire in a synagogue in Pittsburgh, massacring 11 worshippers and telling police “all these Jews need to die.”

Don Albrecht, a 75-year-old accountant and Republican who voted for Trump in 2016, lives blocks away from the Louisville grocery store where two people died. He’d pulled into the parking lot minutes after the gunfire erupted, saw the police cars and shaken employees, and felt like the country’s poisonous political climate had landed in his backyard. He wishes he could take back his vote for Trump.

“He has diarrhea of the mouth and diarrhea of the brain. He’s just so irresponsible,” said Albrecht, who worries Trump’s embrace of the far-right is remaking his party. “I don’t think the American public is going to put up with it. I think there’s going to be a big backlash against Republicans because of this divisiveness.”

Other Trump voters remain staunchly behind him, and plan to choose Republican candidates to help him make good on his pledges, including vows to implement more hardline immigration policies. “I want to see the wall go up,” said Joe Spirko, 57, as he peddled Trump flags outside of one of the president’s rallies in Florida last week. “Since Trump come along, I feel a lot better.”

Trump has stepped up his rhetoric on immigration ahead of the elections, focusing on a caravan of Central American migrants heading toward the United States. Trump and his backers have called it “an invasion” — though the group of a few thousand people, including mothers and children, remains hundreds of miles away — and suggested without proof that there are criminals and terrorists in the crowd of those fleeing violence and poverty. In a White House speech, the president said he would sign an order preventing border-crossers from claiming asylum, a legally questionable proposition, and said he’d told military troops he’s mobilizing to the border to respond to thrown rocks like they were “rifles.”

Julie Hoeppner, a 67-year-old psychologist in Indiana, voted early for Republican candidates, also citing illegal immigration as a primary concern.

A friend recently sent Hoeppner a photo of immigrants arriving at Ellis Island with a note that said: “For our ancestors, this is their caravan.” Hoeppner didn’t respond but thought to herself that her ancestors arrived legally. “Which is a big difference,” she said. “They didn’t come trying to storm the border.”

Pedro Panelo, the 21-year-old president of the College Republicans at Wheaton College in Illinois, is frustrated immigration became a last-minute political football, because the issue is more complex than what either Democrats or Republicans make it out to be. Panelo, the son of a Mexican immigrant, said migrants shouldn’t be demonized, but he stopped short of criticizing the president, and plans to vote for Republican candidates who could help push Trump’s agenda.

“When it comes to his actions, I’m not a huge fan of his tweets,” Panelo said. “But what I say is look what he’s done for the country and not always what he’s said on Twitter.”

He said he’s felt an extraordinary level of enthusiasm for this election among his fellow students. Young people, who historically sit out of midterm elections, and women are both expected to be pivotal forces Tuesday. In Georgia, Democratic campaign volunteer Adrienne White said she struggled to recruit volunteers ahead of the 2016 presidential election but that it’s been easy this year, especially among women.

In Pittsburgh, where residents just finished burying those gunned down at the Tree of Life synagogue, some voters saw their Election Day decisions as a way to send a message that the country is headed down a dark and dangerous path.

“This is probably the most important election in the past 100 years. This will turn the tables,” said Barbara Villa, 71, who with her husband planted a crop of “Vote Blue” signs outside their home.

Rose Cathleen Bagin, 77, lives in the same neighborhood as the synagogue. She lashed a sign to her front porch reading “VOTE FOR GUN CONTROL,” and she is stunned every time she sees the crowd at Trump rallies on television cheering for his divisive language.

“I can’t stand the terrible things he says and the terrible things he’s doing,” said Bagin, who plans to vote Democratic Tuesday. “I’m terrified. We’re going to a place I just don’t understand.”

Democrats’ Pickup Chances Rise In More House Races, Analyst Says

More U.S. House races are competitive and leaning toward Democrats with Election Day tomorrow, according to the latest ratings changes by Cook Political Report. The new rankingsshow nine districts shifting toward Democrats and only one becoming better for Republicans.

Democrats’ chances to pick up seats have improved in key races in Georgia, Pennsylvania, California and Washington, according to ratings changes by Cook’s David Wasserman. The contest to succeed retiring California Republican Darell Issa is likely going to Democrat Mike Levin, and in Washington state’s 8th district, Democrat Kim Schrier’s chance of replacing retiring Republican Dave Reichert has moved from “Toss Up” to “Lean Democratic.”

“Bottom line: anything from a Democratic gain of 20 to 45 seats remains well within the realm of possibility, but a gain of 30 to 40 seats – and House control – is the most likely outcome,” Wasserman wrote today in an online post.

In Georgia, GOP Rep. Karen Handel’s race moved to “Toss Up” from “Lean Republican.”

Handel, elected in a special election last year, is facing headwinds from a gubernatorial contest that is energizing Democrats in her north Atlanta district. Handel’s challenger, Democrat Lucy McBath, is a gun-control activist and African American who could be helped by a possible surge in black voter turnout led by enthusiasm for Georgia gubernatorial candidate Stacey Abrams, according to Wasserman.

Democrats’ Pickup Chances Rise In More House Races, Analyst Says

Meanwhile, a new congressional map in Pennsylvania is giving Freedom Caucus member Scott Perry his first competitive general election bid. The race is now considered a “Toss Up” as the three-term Republican continues to be out raised by Democrat George Scott.

The re-election bids of Republicans Mario Diaz-Balart of Florida and Fred Upton of Michigan both moved from “Likely Republican” to “Lean Republican.” In Texas, House Homeland Security Chairman Michael McCaul’s race and retiring Republican Joe Barton’s open seat were previously considered “Solid Republican,” but now are rated “Likely Republican.” Wasserman also moved West Virginia Republican Representative Alex Mooney’s re-election from “Solid Republican” to “Likely Republican.”

The good news for Republicans out of the latest rating changes is in Arizona’s 1st Congressional District. Incumbent Democrat Tom O’Halleran’s race moved from “Likely Democrat” to “Lean Democrat,” as the freshmen member continues to defend a seat in a district President Donald Trump narrowly won in 2016.

Exclusive poll: Only half of Americans have faith in democracy

Just 51% of Americans said they have faith in democracy, and 37% say they have lost faith in democracy, according to a new Axios/SurveyMonkey poll conducted in late October.

Why it matters: It suggests that recent political turmoil has caused people to doubt the very foundation of American society, particularly leading up to election day.

Since October 2016, just before the last presidential election, SurveyMonkey has tracked Americans’ views toward democracy.

What’s happening: Despite the political turbulence over the past two years, Americans’ faith in democracy has been relatively stable — with two exceptions.

  • Just before heading to the polls in 2016, 52% of voters had faith in democracy.
  • That number grew from pre-election numbers (by 8 percentage points) immediately following the election in November 2016 and in February 2017, after President Trump’s inauguration.
  • One year ago, in October 2017, faith in democracy dropped by 7 percentage points and has held fairly steady since then.
  • The other half of Americans have either lost faith in democracy or never had faith in it to begin with, according to the poll.

The big picture: SurveyMonkey also found that half the country believes America is more divided today than ever before — and that these divisions will probably continue far into the future (ranging between 46% and 51% over the past two years).

  • About one-third of Americans agree America is more divided today, but are optimistic that Americans will come together in the near future.
  • 18% say America is not more divided today than it has been in the past.

Methodology: This survey was conducted Oct. 19–24 among 3,913 adults. Respondents were selected from the more than 2 million people who take surveys on the SurveyMonkey platform each day. Data have been weighted for age, race, sex, education and geography using the Census Bureau’s American Community Survey to reflect the demographic composition of the United States age 18 and over.

Census Bureau estimates of the number of illegals in the U.S. are suspect and may represent significant undercounts. The studies presented by these authors show that the numbers of illegal aliens in the U.S. could range from 20 to 38 million.

Where Would Trump Be If He Had Run as What He Is: the Amnesty Candidate?

One of the great ironies of the 2016 campaign is that Donald Trump, who has run as the immigration scourge, is actually the amnesty candidate.

Trump has expressly vowed to give legal status to millions of illegal aliens. For any other candidate, such a promise would have been the campaign death knell. To compare, John Kasich — who is openly pro-amnesty — has lost 38 of 39 primaries (the sole exception being his own state) and has never been a plausible contestant. When it comes to Trump, however, it seems that the all-important amnesty fine-print of his immigration position has been overlooked. This is no doubt due to his consciously controversial rhetoric: his fixation about building a wall on the Mexican border, his oft-repeated commitment to mass-deportation of illegal aliens, his disparaging comments about Mexicans, and his proposed moratorium on Muslim immigration.

Yet, Trump is the amnesty candidate. What’s more, the amnesty component of his immigration plan is the only part that has a realistic chance of happening.

Trump is not going to build his wall, much less make Mexico pay for it, as he has insisted our southern neighbor will do. Quite apart from the fact that much of the border is not suitable terrain for wall construction, his wall would be astronomically more expensive to build than he has estimated, and in any event, Democrats and many Republicans in Congress would block funding for it. (To be clear: I favor construction of walls and/or fencing where practical; but a wall is only one component, and not nearly the most critical one, of what must be a multi-faceted strategy if we are to be serious about border security.)

Trump’s categorical moratorium on Muslim immigration would also be rejected. It is foolish policy and the legal argument against it, though unpersuasive (aliens outside the U.S. do not have constitutional anti-discrimination rights or any claim on entitlement to admission into our country), would be treated as serious by the Left, the media, and those Republicans who similarly believe that anything foolish must perforce be unconstitutional.

The silliest component of the Trump plan is mass-deportation. There are approximately 11 million illegal aliens in the United States. The Department of Homeland Security does not have the resources to (a) round them all up, (b) conduct the required legal proceedings, and (c) send them all to their native countries. The funding required would dwarf the cost of Trump’s fantasy wall.

Trump fans might claim that it would be an expense worth bearing in order to rid our country of trespassers. But Trump is not saying, “Get out and stay out!”

He is saying: “You must leave … but then you will be welcomed back in.

Donald Trump: Amnesty Shill

Donald Trump Meets DREAMersOne of the reasons attacks on Donald Trump such as National Review’s recent symposium have been ineffective is because they don’t speak to the factors that could actually change his supporters’ minds. Among Trump fans who read conservative commentary, The Donald’s various political heresies, temperamental deficiencies, and personal failings are already priced into their decision—they aren’t prioritizing a full-spectrum conservative, they just want someone who’ll finally shut the border and get our immigration system under control once and for all, and don’t trust anyone else to do it.

So don’t waste space reiterating what they already know and don’t care about. Instead, focus the bulk of your energy dismantling the only good pro-Trump argument—his perceived strength as an immigration hawk—and publicize the truth that, beyond the tough talk about building walls and deporting rapists, he’s as wobbly and inconsistent on the issue as anyone.

There was certainly no reason to believe Trump was anything special on amnesty before 2015:

  • Several media reports allege that Trump knowingly employed illegals on construction projects. Trump denies it, but putting self-interest above principle would hardly be above a man who defends to this day making political contributions “to everybody” explicitly on the basis that they’ll owe him favors.
  • While he may get a lot of press for wanting to deport all the illegals today, in 2012 he argued, “For people that have been here for years, that have been hard workers, have good jobs, they’re supporting their family – it’s very, very tough to just say, ‘By the way, 22 years, you have to leave. Get out.’ I’m one of the world’s very conservative people, but I have to tell you on a human basis, how do you throw somebody out that’s lived in this country for 20 years?”
  • Following the 2012 election, Trump blamed Mitt Romney’s loss in part on his “crazy policy of self deportation which was maniacal,” and the broader sense that Republicans were “mean-spirited about” immigration. Instead, he urged the GOP “to take care of this incredible problem that we have with respect to immigration, with respect to people wanting to be wonderful productive citizens of this country.” The Wall Street Journal couldn’t have said it better themselves.
  • In 2013, during the battle over Marco Rubio’s atrocious Gang of 8 amnesty bill, Trump tweeted, “Congress must protect our borders first. Amnesty should be done only if the border is secure and illegal immigration has stopped”—parroting the GOP conventional wisdom that amnesty is fine as long as we beef up enforcement first.
  • Also in 2013, Trump hosted a meeting with a group of DREAM Act activists, which they claim ended with Trump telling them, “You’ve convinced me.” Even if we assume they’re lying about that quote, it is uncontested that Trump posed for a photo op (above) with the very people we’re now meant to believe he would stand against.

But all that’s in the past, you say. Now he gets how serious illegal immigration is. Now he’s tough as nails. Well…

  • Less than a month after announcing his candidacy, Trump said of illegals currently here, “you have to give them a path, you have to make it possible for them to succeed. You have to do that.”
  • In July, Trump parroted the open-border crowd’s premise that there are “jobs that a citizen of the United States doesn’t want to do,” as well as endorsed expedited legalization for DREAMers (guess they convinced him after all!).
  • For all the attention Trump’s gotten for promising to deport illegals by the millions, Trump’s actual proposal is amnesty. Touchback amnesty, to be specific—“I would get people out and then have an expedited way of getting them back into the country so they can be legal.” His son Eric has even complained that his dad’s not getting more credit for “letting them back in legally.” Mass deportations are a massive waste if the end result is winding up back where we started.
  • Now that he thinks he can woo the very Republican establishment his supporters are revolting against, Trump has decided it’s a good thing to “be a little establishment,” so he can “make great deals for everybody,” going so far as to brag about his chumminess with Nancy Pelosi and Chuck Schumer, and promise, “When I’m president, I’m a different person. I can be the most politically correct person you’ve ever seen.”
  • Just before the Iowa primary vote, Trump said, “you know, if it gets a little boring, if I see people starting to sort of, maybe thinking about leaving, I can sort of tell the audience, I just say, ‘We will build the wall!’ and they go nuts.” Because we didn’t have quite enough reasons to doubt his sincerity.
  • In February, word came out that Trump allegedly admitted to the New York Times that his tough immigration talk was nothing more than a bargaining gambit that would inevitably get watered down in congressional negotiations—a charge he doesn’t deny.

If you think immigration would be uniquely exempt from all of that, think again—which is the message a competent anti-Trump campaign would devote the lion’s share of its energy to hammering home.

Illegal immigration has exploded 57 percent in less than two years, with at least 550,000 new undocumented aliens pouring into America in a trend that is set to continue growing, according to new Census data.

In an analysis of the numbers, the Center for Immigration Studiesfound illegal and legal immigration have reached over 1.5 million a year, a new 15 year high, and a 39 percent increase over 2013.

“You’re looking at a big jump,” said author Steven A. Camarota in an interview with Secrets.

He added that the increasing numbers of legal and illegal immigration and the administration policies sparking the drive to the border have to be “at the center of the national debate” in the presidential election.

Camarota’s 17-page analysis said that immigration over the last two years reached 3.1 million, or more than 1.5 million annually. In the prior two years, 2012-2013, 2.3 million arrived or about 1.1 million each year.

But the number of illegals was shocking, surging to at least 550,000 in 2014 and 2015, up from 350,000 in 2012 and 2013. That’s the size of Albuquerque, N.M.

The report dispels projections that immigration — legal and illegal — would drop due to a pull back in immigrants from Mexico. Instead, it has grown with new countries in Latin America, Cuba and Asia fueling the surge, said the CIS report titled, “New Data: Immigration Surged in 2014 and 2015.”

The numbers raise profound questions about assimilation and the impact of immigration on the nation’s education system, infrastructure, and labor market, as well as the size and density of the U.S. population. It is difficult to find a public policy that has a more profound impact across American society than the level of immigration. It is certainly appropriate that immigration should be at the center of the current presidential election,” concludes Camarota.

The key findings from his report:

— New data collected by the Census Bureau shows that 3.1 million new immigrants (legal and illegal) settled in the country in 2014 and 2015, or more than 1.5 million annually.

— In 2012 and 2013, 2.3 million immigrants arrived, about 1.1 million annually. In 2010 and 2011, 2.1 million new immigrants arrived, about one million annually.

— The big increase in new arrivals in the last two years was driven by a rise in immigration from Latin America, particularly countries other than Mexico; South Asia (e.g. Pakistan and India); and East Asia (e.g. China and Vietnam).

— Our preliminary estimate is that, of the 3.1 million immigrants who arrived in that last two years, about one-third, 1.1 million (or 550,000 annually) were new illegal immigrants, a significant increase from the 700,000 illegal immigrants (350,000 annually) who entered in 2012 and 2013.

— The above estimate of illegal immigration represents the flow of new illegal aliens surreptitiously crossing the border, overstaying a temporary visa, or released into the country after a short detention, such as families from Central America. The numbers do not represent the net increase in the total illegal immigrant population.

— The available evidence also indicates that the number of new legal immigrants, both temporary and permanent, arriving from abroad has increased. Our best estimate is that the arrival of legal immigrants increased about 30 percent, from 1.6 million in 2012-2013 to two million in 2014-2015.

30 Million Illegal Immigrants in US, Says Mexico’s Former Ambassador

Mexico’s former ambassador to the U.S. said that 30 million “undocumented immigrants” are living in the United States in the beginning of an interview before later stating a different number at the conclusion. The former diplomat, Arturo Sarukhan, took to MSNBC to attack presidential hopeful Donald Trump’s recently released plan to secure the border and deport illegal immigrants. The MSNBC clip began with presidential hopeful and Florida Senator Marco Rubio claiming that only 12 or 13 million illegal immigrants are in the country.

The former ambassador stated,” If you were to deport the 30 million undocumented immigrants in the United States that’s going to cost you about 130 billion dollars.” Contrary to the former ambassador’s initial numbers and to Rubio, MSNBC showed an image while Sarukhan spoke claiming 11 million illegal aliens were in the country. Sarukhan then stated later in the interview that there are 11.3 million illegal immigrants in the country, though he did not address his former assertion that 30 million are here. Many conservative and border watchdog groups have long contended that the actual number of illegal immigrants in the U.S. is closer to 30 million while the U.S. government contends the number is closer to 11 million.

Illegal Alien Population in the U.S. (2015)

A definitive count of the number of illegal aliens living in the United States is difficult to obtain. For obvious reasons, those who are in the country illegally are reluctant to come forward to be identified and counted. However, demographers have come up with ways to estimate the size of the illegal alien population. The Department of Homeland Security estimated that 11.4 million illegal aliens were living in the United States in 2012 (DHS, March 2013). Pew Research Center estimated that the illegal alien population in 2014 was 11.3 million (Pew, July 2015).

Robert Warren, a long-time demographer with the Census Bureau and the Immigration and Naturalization Service, and John Robert Warren, a demographer with the Minnesota Population Center, devised a methodology for estimating the illegal alien population that better measured the net change in the annual illegal alien population, and examined the foreign-born population in smaller states more closely than had previous researchers. Their methodology would put the current illegal alien population close to 12 million (Warren & Warren, June 2013).

Under President Obama, DHS has claimed that deportations (officially “removals”) had reached an all-time high. These “record deportations” were achieved not by removing more illegal aliens from the country than under previous administrations, but by changing the way deportations were counted. Under President Obama, DHS began to add the number of illegal aliens apprehended and returned at the border to those removed from the interior of the country –something which had previously been done. Under Obama, the fewest number of illegal aliens have been removed from the country since President Gerald Ford (1974-1977).

It is true that since the Great Recession of 2007-2009, illegal immigration to the United States has slowed down from its peak around 2005. But this does not mean illegal immigration is still not a problem. According to estimates, the illegal alien population has remained statistically unchanged under President Obama, and may actually have begun to increase again (Pew, September 2013). Without a secure border and effective interior enforcement mechanisms in place, it is likely that an improved U.S. economy would attract many more illegal immigrants into the country.

The number of unauthorized immigrants in the U.S. has stabilized in recent years after decades of rapid growth. But there have been shifts in the states where unauthorized immigrants live and the countries where they were born.

President Obama’s executive action on immigration, announced Nov. 20, 2014, would among other thingsexpand deportation relief to almost half the unauthorized immigrant population, though this part of the program is on hold due to a lawsuit to stop the move.While executive actions on immigration have a long history, Obama’s recent action was the most significant protection from deportation offered to unauthorized immigrants since 1986, when Congress passed a law that allowed 2.7 million unauthorized immigrants to obtain a green card.

Here are five facts about the unauthorized immigrant population in the U.S.

1There were 11.3 million unauthorized immigrants in the U.S. in 2014. The population has remained essentially stable for five years, and currently makes up 3.5% of the nation’s population. The number of unauthorized immigrants peaked in 2007 at 12.2 million, when this group was 4% of the U.S. population.

2Mexican Unauthorized Immigrant Population Declines Since 2007 PeakMexicans make up about half of all unauthorized immigrants (49%), though their numbers have been declining in recent years.There were 5.6 million Mexican unauthorized immigrants living in the U.S. in 2014, down from 6.4 million in 2009, according to preliminary Pew Research Center estimates.

3Six states alone account for 60% of unauthorized immigrants — California, Texas, Florida, New York, New Jersey and Illinois. But the distribution of the population is changing. From 2009 to 2012, several East Coast states were among those with population increases, whereas several Western states were among those with population decreases. There were seven states overall in which the unauthorized immigrant population increased: Florida, Idaho, Maryland, Nebraska, New Jersey, Pennsylvania and Virginia. Meanwhile, there were 14 states in which the population decreased over the same time period: Alabama, Arizona, California, Colorado, Georgia, Illinois, Indiana, Kansas, Kentucky, Massachusetts, Nevada, New Mexico, New York and Oregon. Despite a decline, Nevada has the nation’s largest share (8%) of unauthorized immigrants in its state population.

4Unauthorized immigrants make up 5.1% of the U.S. labor force. In the U.S. labor force, there were 8.1 million unauthorized immigrants either working or looking for work in 2012. Among the states, Nevada (10%), California (9%), Texas (9%) and New Jersey (8%) had the highest shares of unauthorized immigrants in their labor forces.

5About 7% of K-12 students had at least one unauthorized immigrant parent in 2012. Among these students, about eight-in-ten (79%) were born in the U.S. In Nevada, almost one-in-five students (18%) have at least one unauthorized immigrant parent, the largest share in the nation. Question: What do you call a tax-hiking, amnesty-supporting, social liberal?The leading GOP presidential contender, Donald J. Trump.

When you take away all the sensationalism oozing from Trump, his governing philosophy is laid bare. He may be an outsider, but he’s also a big, fat squish.

And you don’t have to reach far back into the archives to see it. He’s saying it right now. In real time.

In the span of one interview with the NBC Today Show that aired yesterday, Trump said he would raise taxes, that he favored giving illegal immigrants what’s known as “touchback” amnesty, and that he didn’t mind if men used women’s bathrooms.

His supporters will deny it, but the Democrats can see what a marshmallow Trump is as clearly as conservatives. And they are, no doubt, watching with glee.

“He’s kind of a Manchurian, or maybe a Manhattan-churian candidate, who is really a closet moderate or even liberal on some issues,” President Obama’s former senior advisor David Axelrod told CNN’s New Day Friday morning.

Even Trump’s own aides are telling delegates that Trump’s stump speeches are nothing but a phony act.

It seems that if Trump is the GOP’s nominee, Democrats win either way in 2016.

A new Politico story today reads:

Trump’s chief lieutenants… told skeptical Republican leaders Thursday that… ‘the part that he’s been playing is now evolving’… Trump’s newly hired senior aide, Paul Manafort, [said in a closed-door meeting]: ‘When he’s out on the stage, when he’s talking about the kinds of things he’s talking about on the stump, he’s projecting an image that’s for that purpose… You’ll start to see more depth of the person, the real person. You’ll see a real different guy.’

And for the Democrats, that’s great. “Evolving” is usually code for becoming more liberal.

It seems that if Trump is the GOP’s nominee, Democrats win either way in 2016.

Either Trump loses by massive margins and Hillary Clinton is elected the first female president, or a liberal Republican who will fold on taxes, immigration, and social issues takes the White House. It’s a win-win for the left.

In some circles there is still some — ridiculous — discussion of a unity ticket with Trump and Ted Cruz.

As if, in some world, the GOP’s most principled candidate, Cruz, would suddenly put all his beliefs aside and enlist with Trump, who is largely to the left of Mitt Romney, John McCain, and George Bush combined.

Preposterous.

The fitting unity ticket would never be Trump-Cruz. It would be Clinton-Trump.

IMMIGRATION REFORM THAT WILL MAKE AMERICA GREAT AGAIN

The three core principles of Donald J. Trump’s immigration plan

When politicians talk about “immigration reform” they mean: amnesty, cheap labor and open borders. The Schumer-Rubio immigration bill was nothing more than a giveaway to the corporate patrons who run both parties.

Real immigration reform puts the needs of working people first – not wealthy globetrotting donors. We are the only country in the world whose immigration system puts the needs of other nations ahead of our own. That must change. Here are the three core principles of real immigration reform:

1. A nation without borders is not a nation. There must be a wall across the southern border.

2. A nation without laws is not a nation. Laws passed in accordance with our Constitutional system of government must be enforced.

3. A nation that does not serve its own citizens is not a nation. Any immigration plan must improve jobs, wages and security for all Americans.

Make Mexico Pay For The Wall

For many years, Mexico’s leaders have been taking advantage of the United States by using illegal immigration to export the crime and poverty in their own country (as well as in other Latin American countries). They have even published pamphletson how to illegally immigrate to the United States. The costs for the United States have been extraordinary: U.S. taxpayers have been asked to pick up hundreds of billions in healthcare costs, housing costs, education costs, welfare costs, etc. Indeed, the annual cost of free tax credits alone paid to illegal immigrants quadrupled to $4.2 billion in 2011. The effects on jobseekers have also been disastrous, and black Americans have been particularly harmed.

The impact in terms of crime has been tragic. In recent weeks, the headlines have been covered with cases of criminals who crossed our border illegally only to go on to commit horrific crimes against Americans. Most recently, an illegal immigrant from Mexico, with a long arrest record, is charged with breaking into a 64 year-old woman’s home, crushing her skull and eye sockets with a hammer, raping her, and murdering her. The Police Chief in Santa Maria says the “blood trail” leads straight to Washington.

In 2011, the Government Accountability Office found that there were a shocking 3 million arrests attached to the incarcerated alien population, including tens of thousands of violent beatings, rapes and murders.

Meanwhile, Mexico continues to make billions on not only our bad trade deals but also relies heavily on the billions of dollars in remittances sent from illegal immigrants in the United States back to Mexico ($22 billion in 2013 alone).

In short, the Mexican government has taken the United States to the cleaners. They are responsible for this problem, and they must help pay to clean it up.

The cost of building a permanent border wall pales mightily in comparison to what American taxpayers spend every single year on dealing with the fallout of illegal immigration on their communities, schools and unemployment offices.

Mexico must pay for the wall and, until they do, the United States will, among other things: impound all remittance payments derived from illegal wages; increase fees on all temporary visas issued to Mexican CEOs and diplomats (and if necessary cancel them); increase fees on all border crossing cards – of which we issue about 1 million to Mexican nationals each year (a major source of visa overstays); increase fees on all NAFTA worker visas from Mexico (another major source of overstays); and increase fees at ports of entry to the United States from Mexico [Tariffs and foreign aid cuts are also options].  We will not be taken advantage of anymore.

Defend The Laws And Constitution Of The United States

America will only be great as long as America remains a nation of laws that lives according to the Constitution. No one is above the law. The following steps will return to the American people the safety of their laws, which politicians have stolen from them:

Triple the number of ICE officers. As the President of the ICE Officers’ Council explained in Congressional testimony: “Only approximately 5,000 officers and agents within ICE perform the lion’s share of ICE’s immigration mission…Compare that to the Los Angeles Police Department at approximately 10,000 officers. Approximately 5,000 officers in ICE cover 50 states, Puerto Rico and Guam, and are attempting to enforce immigration law against 11 million illegal aliens already in the interior of the United States. Since 9-11, the U.S. Border Patrol has tripled in size, while ICE’s immigration enforcement arm, Enforcement and Removal Operations (ERO), has remained at relatively the same size.” This will be funded by accepting the recommendation of the Inspector General for Tax Administration and eliminating tax credit payments to illegal immigrants.

Nationwide e-verify. This simple measure will protect jobs for unemployed Americans.

Mandatory return of all criminal aliens. The Obama Administration has released 76,000 aliens from its custody with criminal convictions since 2013 alone. All criminal aliens must be returned to their home countries, a process which can be aided by canceling any visas to foreign countries which will not accept their own criminals, and making it a separate and additional crime to commit an offense while here illegally.

Detention—not catch-and-release. Illegal aliens apprehended crossing the border must be detained until they are sent home, no more catch-and-release.

Defund sanctuary cities. Cut-off federal grants to any city which refuses to cooperate with federal law enforcement.

Enhanced penalties for overstaying a visa. Millions of people come to the United States on temporary visas but refuse to leave, without consequence. This is a threat to national security. Individuals who refuse to leave at the time their visa expires should be subject to criminal penalties; this will also help give local jurisdictions the power to hold visa overstays until federal authorities arrive. Completion of a visa tracking system – required by law but blocked by lobbyists – will be necessary as well.

Cooperate with local gang task forces. ICE officers should accompany local police departments conducting raids of violent street gangs like MS-13 and the 18th street gang, which have terrorized the country. All illegal aliens in gangs should be apprehended and deported. Again, quoting Chris Crane: “ICE Officers and Agents are forced to apply the Deferred Action for Childhood Arrivals (DACA) Directive, not to children in schools, but to adult inmates in jails. If an illegal-alien inmate simply claims eligibility, ICE is forced to release the alien back into the community. This includes serious criminals who have committed felonies, who have assaulted officers, and who prey on children…ICE officers should be required to place detainers on every illegal alien they encounter in jails and prisons, since these aliens not only violated immigration laws, but then went on to engage in activities that led to their arrest by police; ICE officers should be required to issue Notices to Appear to all illegal aliens with criminal convictions, DUI convictions, or a gang affiliation; ICE should be working with any state or local drug or gang task force that asks for such assistance.”

End birthright citizenship. This remains the biggest magnet for illegal immigration. By a 2:1 margin, voters say it’s the wrong policy, including Harry Reid who said “no sane country” would give automatic citizenship to the children of illegal immigrants.

Put American Workers First

Decades of disastrous trade deals and immigration policies have destroyed our middle class. Today, nearly 40% of black teenagers are unemployed. Nearly 30% of Hispanic teenagers are unemployed. For black Americans without high school diplomas, the bottom has fallen out: more than 70% were employed in 1960, compared to less than 40% in 2000. Across the economy, the percentage of adults in the labor force has collapsed to a level not experienced in generations. As CBS news wrote in a piece entitled “America’s incredible shrinking middle class”: “If the middle-class is the economic backbone of America, then the country is developing osteoporosis.”

The influx of foreign workers holds down salaries, keeps unemployment high, and makes it difficult for poor and working class Americans – including immigrants themselves and their children – to earn a middle class wage. Nearly half of all immigrants and their US-born children currently live in or near poverty, including more than 60 percent of Hispanic immigrants. Every year, we voluntarily admit another 2 million new immigrants, guest workers, refugees, and dependents, growing our existing all-time historic record population of 42 million immigrants. We need to control the admission of new low-earning workers in order to: help wages grow, get teenagers back to work, aid minorities’ rise into the middle class, help schools and communities falling behind, and to ensure our immigrant members of the national family become part of the American dream.

Additionally, we need to stop giving legal immigrant visas to people bent on causing us harm. From the 9/11 hijackers, to the Boston Bombers, and many others, our immigration system is being used to attack us. The President of the immigration caseworkers union declared in a statement on ISIS: “We’ve become the visa clearinghouse for the world.”

Here are some additional specific policy proposals for long-term reform:

Increase prevailing wage for H-1Bs. We graduate two times more Americans with STEM degrees each year than find STEM jobs, yet as much as two-thirds of entry-level hiring for IT jobs is accomplished through the H-1B program. More than half of H-1B visas are issued for the program’s lowest allowable wage level, and more than eighty percent for its bottom two. Raising the prevailing wage paid to H-1Bs will force companies to give these coveted entry-level jobs to the existing domestic pool of unemployed native and immigrant workers in the U.S., instead of flying in cheaper workers from overseas. This will improve the number of black, Hispanic and female workers in Silicon Valley who have been passed over in favor of the H-1B program. Mark Zuckerberg’s personal Senator, Marco Rubio, has a bill to triple H-1Bs that would decimate women and minorities.

Requirement to hire American workers first. Too many visas, like the H-1B, have no such requirement. In the year 2015, with 92 million Americans outside the workforce and incomes collapsing, we need companies to hire from the domestic pool of unemployed. Petitions for workers should be mailed to the unemployment office, not USCIS.

End welfare abuse. Applicants for entry to the United States should be required to certify that they can pay for their own housing, healthcare and other needs before coming to the U.S.

Jobs program for inner city youth. The J-1 visa jobs program for foreign youth will be terminated and replaced with a resume bank for inner city youth provided to all corporate subscribers to the J-1 visa program.

Refugee program for American children. Increase standards for the admission of refugees and asylum-seekers to crack down on abuses. Use the monies saved on expensive refugee programs to help place American children without parents in safer homes and communities, and to improve community safety in high crime neighborhoods in the United States.

Immigration moderation. Before any new green cards are issued to foreign workers abroad, there will be a pause where employers will have to hire from the domestic pool of unemployed immigrant and native workers. This will help reverse women’s plummeting workplace participation rate, grow wages, and allow record immigration levels to subside to more moderate historical averages.

8 U.S. Code § 1227 – Deportable aliens

(a)Classes of deportable aliensAny alien (including an alien crewman) in and admitted to the United States shall, upon the order of the Attorney General, be removed if the alien is within one or more of the following classes of deportable aliens:

(1)Inadmissible at time of entry or of adjustment of status or violates status

(A)Inadmissible aliens

Any alien who at the time of entry or adjustment of status was within one or more of the classes of aliens inadmissible by the law existing at such time is deportable.

(B)Present in violation of law

Any alien who is present in the United States in violation of this chapter or any other law of the United States, or whose nonimmigrant visa (or other documentation authorizing admission into the United States as a nonimmigrant) has been revoked under section 1201(i) of this title, is deportable.

(C)Violated nonimmigrant status or condition of entry

(i)Nonimmigrant status violators

Any alien who was admitted as a nonimmigrant and who has failed to maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 1258 of this title, or to comply with the conditions of any such status, is deportable.

(ii)Violators of conditions of entry

Any alien whom the Secretary of Health and Human Services certifies has failed to comply with terms, conditions, and controls that were imposed under section 1182(g) of this title is deportable.

(D)Termination of conditional permanent residence

(i)In general

Any alien with permanent resident status on a conditional basis under section 1186a of this title (relating to conditional permanent resident status for certain alien spouses and sons and daughters) or under section 1186b of this title (relating to conditional permanent resident status for certain alien entrepreneurs, spouses, and children) who has had such status terminated under such respective section is deportable.

(ii)Exception

Clause (i) shall not apply in the cases described in section 1186a(c)(4) of this title (relating to certain hardship waivers).

(E)Smuggling

(i)In general

Any alien who (prior to the date of entry, at the time of any entry, or within 5 years of the date of any entry) knowingly has encouraged, induced, assisted, abetted, or aided any other alien to enter or to try to enter the United States in violation of law is deportable.

(ii)Special rule in the case of family reunification

Clause (i) shall not apply in the case of alien who is an eligible immigrant (as defined in section 301(b)(1) of the Immigration Act of 1990), was physically present in the United States on May 5, 1988, and is seeking admission as an immediate relative or under section 1153(a)(2) of this title (including under section 112 of the Immigration Act of 1990) or benefits under section 301(a) of the Immigration Act of 1990 if the alien, before May 5, 1988, has encouraged, induced, assisted, abetted, or aided only the alien’s spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.

(iii)Waiver authorized

The Attorney General may, in his discretion for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest, waive application of clause (i) in the case of any alien lawfully admitted for permanent residence if the alien has encouraged, induced, assisted, abetted, or aided only an individual who at the time of the offense was the alien’s spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.

(G)Marriage fraudAn alien shall be considered to be deportable as having procured a visa or other documentation by fraud (within the meaning of section 1182(a)(6)(C)(i) of this title) and to be in the United States in violation of this chapter (within the meaning of subparagraph (B)) if—

(i)

the alien obtains any admission into the United States with an immigrant visa or other documentation procured on the basis of a marriage entered into less than 2 years prior to such admission of the alien and which, within 2 years subsequent to any admission of the alien in the United States, shall be judicially annulled or terminated, unless the alien establishes to the satisfaction of the Attorney General that such marriage was not contracted for the purpose of evading any provisions of the immigration laws, or

(ii)

it appears to the satisfaction of the Attorney General that the alien has failed or refused to fulfill the alien’s marital agreement which in the opinion of the Attorney General was made for the purpose of procuring the alien’s admission as an immigrant.

(H)Waiver authorized for certain misrepresentationsThe provisions of this paragraph relating to the removal of aliens within the United States on the ground that they were inadmissible at the time of admission as aliens described in section 1182(a)(6)(C)(i) of this title, whether willful or innocent, may, in the discretion of the Attorney General, be waived for any alien (other than an alien described in paragraph (4)(D)) who—

(i)

(I)

is the spouse, parent, son, or daughter of a citizen of the United States or of an alien lawfully admitted to the United States for permanent residence; and

(II)

was in possession of an immigrant visa or equivalent document and was otherwise admissible to the United States at the time of such admission except for those grounds of inadmissibility specified under paragraphs (5)(A) and (7)(A) ofsection 1182(a) of this title which were a direct result of that fraud or misrepresentation.

(ii)

is a VAWA self-petitioner.
A waiver of removal for fraud or misrepresentation granted under this subparagraph shall also operate to waive removal based on the grounds of inadmissibility directly resulting from such fraud or misrepresentation.

(2)Criminal offenses

(A)General crimes

(i)Crimes of moral turpitudeAny alien who—

(I)

is convicted of a crime involving moral turpitude committed within five years (or 10 years in the case of an alien provided lawful permanent resident status under section 1255(j) of this title) after the date of admission, and

(II)

is convicted of a crime for which a sentence of one year or longer may be imposed,
 is deportable.

(ii)Multiple criminal convictions

Any alien who at any time after admission is convicted of two or more crimes involving moral turpitude, not arising out of a single scheme of criminal misconduct, regardless of whether confined therefor and regardless of whether the convictions were in a single trial, is deportable.

(iii)Aggravated felony

Any alien who is convicted of an aggravated felony at any time after admission is deportable.

(iv)High speed flight

Any alien who is convicted of a violation of section 758 of title 18 (relating to high speed flight from an immigration checkpoint) is deportable.

(v)Failure to register as a sex offender

Any alien who is convicted under section 2250 of title 18 is deportable.

(vi)Waiver authorized

Clauses (i), (ii), (iii), and (iv) shall not apply in the case of an alien with respect to a criminal conviction if the alien subsequent to the criminal conviction has been granted a full and unconditional pardon by the President of the United States or by the Governor of any of the several States.

(B)Controlled substances

(i)Conviction

Any alien who at any time after admission has been convicted of a violation of (or a conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance (as defined in section 802 of title 21), other than a single offense involving possession for one’s own use of 30 grams or less of marijuana, is deportable.

(ii)Drug abusers and addicts

Any alien who is, or at any time after admission has been, a drug abuser or addict is deportable.

(C)Certain firearm offenses

Any alien who at any time after admission is convicted under any law of purchasing, selling, offering for sale, exchanging, using, owning, possessing, or carrying, or of attempting or conspiring to purchase, sell, offer for sale, exchange, use, own, possess, or carry, any weapon, part, or accessory which is a firearm or destructive device (as defined in section 921(a) of title 18) in violation of any law is deportable.

(D)Miscellaneous crimesAny alien who at any time has been convicted (the judgment on such conviction becoming final) of, or has been so convicted of a conspiracy or attempt to violate—

(i)

any offense under chapter 37 (relating to espionage), chapter 105 (relating to sabotage), or chapter 115 (relating to treason and sedition) of title 18 for which a term of imprisonment of five or more years may be imposed;

(ii)

any offense under section 871 or 960 of title 18;

(iii)

a violation of any provision of the Military Selective Service Act (50 U.S.C. App. 451 et seq.) [now 50 U.S.C. 3801 et seq.] or the Trading With the Enemy Act (50 U.S.C. App. 1 et seq.) [now 50 U.S.C. 4301 et seq.]; or

(iv)

a violation of section 1185 or 1328 of this title,
is deportable.

(E)Crimes of domestic violence, stalking, or violation of protection order, crimes against children and

(i)Domestic violence, stalking, and child abuse

Any alien who at any time after admission is convicted of a crime of domestic violence, a crime of stalking, or a crime of child abuse, child neglect, or child abandonment is deportable. For purposes of this clause, the term “crime of domestic violence” means any crime of violence (as defined in section 16 of title 18) against a person committed by a current or former spouse of the person, by an individual with whom the person shares a child in common, by an individual who is cohabiting with or has cohabited with the person as a spouse, by an individual similarly situated to a spouse of the person under the domestic or family violence laws of the jurisdiction where the offense occurs, or by any other individual against a person who is protected from that individual’s acts under the domestic or family violence laws of the United States or any State, Indian tribal government, or unit of local government.

(ii)Violators of protection orders

Any alien who at any time after admission is enjoined under a protection order issued by a court and whom the court determines has engaged in conduct that violates the portion of a protection order that involves protection against credible threats of violence, repeated harassment, or bodily injury to the person or persons for whom the protection order was issued is deportable. For purposes of this clause, the term “protection order” means any injunction issued for the purpose of preventing violent or threatening acts of domestic violence, including temporary or final orders issued by civil or criminal courts (other than support or child custody orders or provisions) whether obtained by filing an independent action or as a pendente lite order in another proceeding.

(F)Trafficking

Any alien described in section 1182(a)(2)(H) of this title is deportable.

(3)Failure to register and falsification of documents

(A)Change of address

An alien who has failed to comply with the provisions of section 1305 of this title is deportable, unless the alien establishes to the satisfaction of the Attorney General that such failure was reasonably excusable or was not willful.

(B)Failure to register or falsification of documentsAny alien who at any time has been convicted—

(i)

under section 1306(c) of this title or under section 36(c) of the Alien Registration Act, 1940,

(ii)

of a violation of, or an attempt or a conspiracy to violate, any provision of the Foreign Agents Registration Act of 1938 (22 U.S.C. 611 et seq.), or

(iii)

of a violation of, or an attempt or a conspiracy to violate, section 1546 of title 18 (relating to fraud and misuse of visas, permits, and other entry documents),
is deportable.

(C)Document fraud

(i)In general

An alien who is the subject of a final order for violation of section 1324c of this title is deportable.

(ii)Waiver authorized

The Attorney General may waive clause (i) in the case of an alien lawfully admitted for permanent residence if no previous civil money penalty was imposed against the alien under section 1324c of this title and the offense was incurred solely to assist, aid, or support the alien’s spouse or child (and no other individual). No court shall have jurisdiction to review a decision of the Attorney General to grant or deny a waiver under this clause.

(D)Falsely claiming citizenship

(i)In general

Any alien who falsely represents, or has falsely represented, himself to be a citizen of the United States for any purpose or benefit under this chapter (including section 1324a of this title) or any Federal or State law is deportable.

(ii)Exception

In the case of an alien making a representation described in clause (i), if each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization), the alien permanently resided in the United States prior to attaining the age of 16, and the alien reasonably believed at the time of making such representation that he or she was a citizen, the alien shall not be considered to be deportable under any provision of this subsection based on such representation.

(4)Security and related grounds

(A)In generalAny alien who has engaged, is engaged, or at any time after admission engages in—

(i)

any activity to violate any law of the United States relating to espionage or sabotage or to violate or evade any law prohibiting the export from the United States of goods, technology, or sensitive information,

(ii)

any other criminal activity which endangers public safety or national security, or

(iii)

any activity a purpose of which is the opposition to, or the control or overthrow of, the Government of the United States by force, violence, or other unlawful means,
is deportable.

(B)Terrorist activities

Any alien who is described in subparagraph (B) or (F) of section 1182(a)(3) of this title is deportable.

(C)Foreign policy

(i)In general

An alien whose presence or activities in the United States the Secretary of State has reasonable ground to believe would have potentially serious adverse foreign policy consequences for the United States is deportable.

(ii)Exceptions

The exceptions described in clauses (ii) and (iii) of section 1182(a)(3)(C) of this title shall apply to deportability under clause (i) in the same manner as they apply to inadmissibility under section 1182(a)(3)(C)(i) of this title.

(D)Participated in Nazi persecution, genocide, or the commission of any act of torture or extrajudicial killing

Any alien described in clause (i), (ii), or (iii) of section 1182(a)(3)(E) of this title is deportable.

(E)Participated in the commission of severe violations of religious freedom

Any alien described in section 1182(a)(2)(G) of this title is deportable.

(F)Recruitment or use of child soldiers

Any alien who has engaged in the recruitment or use of child soldiers in violation of section 2442 of title 18 is deportable.

(5)Public charge

Any alien who, within five years after the date of entry, has become a public charge from causes not affirmatively shown to have arisen since entry is deportable.

(6)Unlawful voters

(A)In general

Any alien who has voted in violation of any Federal, State, or local constitutional provision, statute, ordinance, or regulation is deportable.

(B)Exception

In the case of an alien who voted in a Federal, State, or local election (including an initiative, recall, or referendum) in violation of a lawful restriction of voting to citizens, if each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization), the alien permanently resided in the United States prior to attaining the age of 16, and the alien reasonably believed at the time of such violation that he or she was a citizen, the alien shall not be considered to be deportable under any provision of this subsection based on such violation.

(7)Waiver for victims of domestic violence

(A)In generalThe Attorney General is not limited by the criminal court record and may waive the application of paragraph (2)(E)(i) (with respect to crimes of domestic violence and crimes of stalking) and (ii) in the case of an alien who has been battered or subjected to extreme cruelty and who is not and was not the primary perpetrator of violence in the relationship—

(i)[1] upon a determination that—

(I)

the alien was acting is [2] self-defense;

(II)

the alien was found to have violated a protection order intended to protect the alien; or

(III)the alien committed, was arrested for, was convicted of, or pled guilty to committing a crime—

(aa)

that did not result in serious bodily injury; and

(bb)

where there was a connection between the crime and the alien’s having been battered or subjected to extreme cruelty.

(B)Credible evidence considered

In acting on applications under this paragraph, the Attorney General shall consider any credible evidence relevant to the application. The determination of what evidence is credible and the weight to be given that evidence shall be within the sole discretion of the Attorney General.

(b)Deportation of certain nonimmigrants

An alien, admitted as a nonimmigrant under the provisions of either section 1101(a)(15)(A)(i) or 1101(a)(15)(G)(i) of this title, and who fails to maintain a status under either of those provisions, shall not be required to depart from the United States without the approval of the Secretary of State, unless such alien is subject to deportation under paragraph (4) of subsection (a).

(c)Waiver of grounds for deportation

Paragraphs (1)(A), (1)(B), (1)(C), (1)(D), and (3)(A) of subsection (a) (other than so much of paragraph (1) as relates to a ground of inadmissibility described in paragraph (2) or (3) of section 1182(a) of this title) shall not apply to a special immigrant described in section 1101(a)(27)(J) of this title based upon circumstances that existed before the date the alien was provided such special immigrant status.

(d)Administrative stay

(1)If the Secretary of Homeland Security determines that an application for nonimmigrant status under subparagraph (T) or (U) ofsection 1101(a)(15) of this title filed for an alien in the United States sets forth a prima facie case for approval, the Secretary may grant the alien an administrative stay of a final order of removal under section 1231(c)(2) of this title until—

(A)

the application for nonimmigrant status under such subparagraph (T) or (U) is approved; or

(B)

there is a final administrative denial of the application for such nonimmigrant status after the exhaustion of administrative appeals.

(2)

The denial of a request for an administrative stay of removal under this subsection shall not preclude the alien from applying for a stay of removal, deferred action, or a continuance or abeyance of removal proceedings under any other provision of the immigration laws of the United States.

(3)

During any period in which the administrative stay of removal is in effect, the alien shall not be removed.

(4)

Nothing in this subsection may be construed to limit the authority of the Secretary of Homeland Security or the Attorney General to grant a stay of removal or deportation in any case not described in this subsection.

We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.


Article. I.

Section. 1.

All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives. …

Section. 3.

… The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law. ”’

Section. 7.

All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States; If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively. If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law. …

Article. II.

Section. 1.

The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows …

Section. 4.

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Article. IV.

Section. 4.

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence. …

Sen. Ted Cruz, R-Tex., told a Washington, D.C. audience today that “the pattern of lawlessness by [the Obama] Administration should concern every citizen, regardless of party or ideology.”

His speech to the Federalist Society, a conservative legal group, came on the same day the Texas Republican released his fourth report on the Obama Administration’s “abuse of power” and executive over-reaches.

Cruz’s “Legal Limit Report No. 4″ documents “76 instances of lawlessness and other abuses of power” and catalogues how Obama abused his power in Cruz’s opinion.

During Cruz’s remarks at the Federalist Society’s annual Executive Branch Review Conference, he said that that “rather than any particular tree” the report “focuses on the entire forest” of Obama’s lawlessness.

“How many of you have your cellphone?” the Senator asked his audience. “Please leave your cellphones on: I want to make sure President Obama hears everything we say,” he joked.

“Rule of law means that we are a nation ruled by laws, not men. No one — and especially not the president — is above the law. For that reason, the U.S. Constitution imposes on every president the express duty to ‘take Care that the Laws be faithfully executed.’ Rather than honor this duty, President Obama has openly defied it by repeatedly suspending, delaying, and waiving portions of the laws that he is charged to enforce,” Cruz asserts in the 12-page report.

In his report, Cruz denounces “the Administration’s disregard for current drug, immigration, welfare and marriage laws.

“The White House’s false portrayal about events in Benghazi,” and the “exemptions, waiver, and delays associated with the implementation of Obamacare.”

Cruz, who is considered a potential GOP presidential contender, ended his speech by saying: “President Obama is not always going to be president. There will come another president and in time, there will even come a Republican president. And I ask all of those on the left who were so hacky about this how exactly they would feel about a Republican president exercising this power.”

He added that a Republican president will presumably focus on different policies than a Democratic one.

“So rather than easing the work requirements of welfare” or implementing laws “to accept gay marriage,” Cruz continued, “you might see a Republican president for example saying we’re not going to enforce certain environmental laws, we’re not going to enforce certain labor laws, we’re not going to enforce a whole host of laws that our system has worked so hard to pass.”

Feds released hundreds of immigrant murderers, drunk drivers, sex-crimes convicts

Immigration officials knowingly released dozens of murderers and thousands of drunken drivers back into the U.S. in 2013, according to Obama administration statistics that could undercut the president’s argument that he is trying to focus on the most serious criminals in his immigration enforcement.

Among the 36,000 immigrants whom U.S. Immigration and Customs Enforcement released from custody last year there were 116 with convictions for homicide, 43 for negligent manslaughter, 14 for voluntary manslaughter and one with a conviction classified by ICE as “homicide-willful kill-public official-gun.”

The immigrants were in deportation proceedings, meaning ICE was trying to remove them from the country and could have held them in detention but released them anyway, according to the Center for Immigration Studies, which published the numbers Monday. The Washington Times also obtained the data.

“This would be considered the worst prison break in American history, except it was sanctioned by the president and perpetrated by our own immigration officials,” said Rep. Lamar Smith, Texas Republican. “The administration’s actions are outrageous. They willfully and knowingly put the interests of criminal immigrants before the safety and security of the American people.”

The data raised thorny questions about how the government decides which immigrants to detain and which it will release as they await court hearings and final action on deportation.

Jessica Vaughan, policy studies director at the Center for Immigration Studies, said the numbers undercut the Obama administration’s argument that it is trying to keep its enforcement efforts targeted at dangerous criminals.

“We keep hearing from the administration that they are focused like a laser on enforcement against the worst of the worst, convicted criminals, as their top priority. On the other hand, they are releasing, at a rate of about 100 a day, aliens from their custody with criminal convictions, and many of them are serious criminal convictions,” she said.

In a statement, ICE said many of those it released were subject to electronic monitoring, posting bond or having to check in with officers.

In other cases, the agency was required to release immigrants because of court decisions, including a 2001 Supreme Court ruling that found immigrants whose home countries refused to take them back could not be held for more than six months.

ICE said 75 percent of the convicted murderers released in 2013 were considered “mandatory releases” in compliance with court decisions.

“Others, typically those with less serious offenses, were released as a discretionary matter after career law enforcement officers made a judgment regarding the priority of holding the individual, given ICE’s resources, and prioritizing the detention and removal of individuals who pose a risk to public safety or national security,” ICE said.

Rep. Bob Goodlatte, chairman of the House Judiciary Committee, said Homeland Security Secretary Jeh Johnson will have to answer questions.

Mr. Goodlatte and Mr. Smith asked ICE for the release numbers but said the agency never turned them over.

“These criminals should be locked up, not roaming our streets,” the lawmakers said.

ICE has told Congress it doesn’t need to hold as many immigrants in detention. In its budget request this year, ICE asked that Congress fund slightly more than 30,500 detention beds a day, down from the 34,000 set in current law.

Lamar Smith Calls ICE Release of 36,000 Criminal Immigrants a President-Sanctioned Prison Break

Texas Republican Rep. Lamar Smith reacted harshly to a new report detailing the crimes committed by 36,007 criminal immigrants that Immigration and Customs Enforcement released last year.

“This would be considered the worst prison break in American history, except it was sanctioned by the President and perpetrated by our own immigration officials. These criminal immigrants should have been deported to ensure that they could never commit crimes on U.S. soil. But instead, ICE officials chose not to detain them and instead released them back onto American streets,” Smith said in a statement Monday.

An internal Department of Homeland Security document obtained by the Center for Immigration Studies, a limited immigration group, and shared with Breitbart News Monday revealed that last year ICE released 36,007 criminal immigrants who had nearly 88,000 convictions.

The document further broke down the crimes and number of convictions – including 193 homicide convictions, 426 sexual assault convictions, 303 kidnapping convictions, and 1,075 aggravated assault convictions.

CIS detailed the document’s findings in a report Monday morning, explaining that ICE prepared the document in response to congressional inquiries seeking additional information about the number of criminal aliens released into the United States and the crimes for which they were convicted.

Smith was one of the members of Congress who pressed DHS for these answers.

The congressman actually did receive a response from DHS earlier this year explaining that ICE did release 36,007 criminal aliens. DHS also included a breakdown of the kinds of offenses but did not include the number of offenses per type of crime.

“Obama administration officials want the American people to think these individuals were guilty of minor, petty offenses,” Smith said. “But the convictions tell a chilling story. Among those released were criminal immigrants convicted of murder, rape, kidnapping, drunk driving, and aggravated assault.”

The Texas congressman added that immigration reform should be off the table until laws currently on the books are enforced.

“There should be no discussion of reforming our nation’s immigration laws until the President enforces the laws currently on the books. The safety of the American people should be the President’s top priority. We need a President who follows the law and deports criminal immigrants who violate our laws and endanger our lives.”

ICE has not responded to the CIS report, but told Breitbart News Monday morning they are looking into it.

Raw Statistics Reveal the Real Story of ICE Enforcement in Decline

A key talking point for proponents of amnesty for illegal aliens is that the Obama administration has made historic improvements to border security and immigration enforcement, leading to “record” numbers of deportations that surpass the performance of earlier administrations. In December 2012, John Morton, then-director of U.S. Immigration and Customs Enforcement (ICE), announced that his agency had removed nearly 410,000 illegal aliens that year. Major news outlets, pro-amnesty lawmakers, and other Obama administration allies heralded this apparent milestone as evidence that the border and illegal immigration were now under control.

On the same day, to far less fanfare, Morton also announced the implementation of new restrictions on how the agents and officers working under him could use their authority to enforce immigration laws. They were told to curtail the use of detainers, or immigration holds, which give ICE officers the opportunity to question and take custody of illegal aliens identified after arrest by a local law enforcement agency. This directive built on an earlier memo, issued in June 2011, which ordered ICE agents not to arrest certain broad categories of illegal aliens, including minor criminals, long-time residents, students, parents, caregivers, and a long list of other excepted categories for whom there was otherwise no statutory basis for special treatment. These and other directives have been euphemistically characterized as “prosecutorial discretion.”

This report examines data from a collection of mostly unpublished internal Department of Homeland Security (DHS) and ICE statistics, to provide an alternative evaluation of the administration’s record on immigration enforcement that is based on raw statistics rather than pre-packaged press kits. These statistics show that, contrary to what is commonly believed, in fact immigration enforcement in the interior has slowed significantly in the last few years. ICE is arresting and removing noticeably fewer illegal aliens from the interior now than was the case five years ago, and even two years ago. Its focus has shifted away from interior enforcement in favor of processing aliens who are apprehended by the Border Patrol.

While the agency claims that it has stewarded resources effectively by guiding agents to hone in on criminals, in fact the number of criminal aliens removed from the interior also has declined, even as ICE’s Enforcement and Removal Operations division (ERO) is notified of more arrested criminal aliens than ever before, through the Secure Communities program. These statistics stand in stark contrast to claims of “record deportations,” which largely have been taken at face value by the news media and many lawmakers.

The report also presents previously unpublished statistics disclosing the startlingly large number of cases on ICE’s post-final-order docket of aliens who have been ordered removed, but who remain living here in defiance of immigration enforcement. These “non-departed” illegal aliens are emblematic of the dysfunction in our immigration system, and must become a priority for enforcement before public trust in our system can be restored.

Key Findings:

  • The number of deportations resulting from interior enforcement by ICE declined by 19 percent from 2011 to 2012, and is on track to decline another 22 percent in 2013.
  • In 2012, the year the Obama administration claimed to break enforcement records, more than one-half of removals attributed to ICE were the result of Border Patrol arrests that would never have been counted as a removal in prior years. In 2008, under the Bush administration, only one-third of removals were from Border Patrol arrests.
  • Total deportations in 2011, the latest year for which complete numbers are available, numbered 715,495 – the lowest level since 1973. The highest number of deportations on record was in 2000, under the Clinton administration, when 1,864,343 aliens were deported.
  • When claiming record levels of enforcement, the Obama administration appears to count only removals, which are just one form of deportation, and only a partial measure of enforcement. Beginning in 2011, a shift of some of the routine Border Patrol case load to ICE enabled the administration to count an artificially high number of removals.
  • Homeland Security Investigations (HSI), the division of ICE that is responsible for work site enforcement, combating transnational gangs, overstay enforcement, anti-smuggling and trafficking activity, and busting document and identity theft rings, now contributes very little to immigration enforcement. In 2013 HSI has produced only four percent of ICE deportations, making just a few thousand arrests per year throughout the entire country.
  • ICE is doing less enforcement with more resources. Despite reporting more encounters in 2013 than 2012, ICE agents pursued deportation of 20 percent fewer aliens this year than last.
  • Enforcement activity declined in every ICE field office from 2011 to 2013, with the biggest declines in the Atlanta, Salt Lake City, Washington DC/Virginia, and Houston field offices.
  • Criminal alien arrests declined by 11 percent from 2012 to 2013, despite the completion of the Secure Communities program, which generates more referrals of arrested aliens than ever before. ICE agents took a pass on hundreds of thousands of aliens who were arrested by local authorities in those years.
  • ICE is carrying a case load of 1.8 million aliens who are either in removal proceedings or have already been ordered removed. Less than two percent are in detention, which is the only proven way to ensure departure.
  • As of the end of July 2013 there were 872,000 aliens – nearly half of ICE’s total docket – who had been ordered removed but who had not left the country.
  • The State Department continues to issue tens of thousands of visas annually to citizens of countries that refuse to take back their countrymen who are ordered removed from the United States. Many of these are violent criminals.

The statistics in the tables and charts in this report are taken from internal DHS documents obtained by the Center, including:

  • a series of reports prepared by the ICE/ERO Statistical Tracking Unit as part of the discovery process for Crane v. Napolitano, the lawsuit brought by ICE agents to challenge the Obama administration’s “prosecutorial discretion” and Deferred Action for Childhood Arrivals (DACA) policies;
  • two editions of the Weekly Departures and Detention Report covering the same 10-month period of fiscal years 2011-2013 (October 1 to the end of July), prepared by the Statistical Tracking Unit of the ICE Enforcement and Removals Operations division; and
  • the Yearbook of Immigration Statistics published by DHS.

Total Deportations: Lowest Number Since 1973

Figure 1 shows the total number of expulsions from the United States from 1982 to 2011. This action is commonly known as a “deportation.” In technical immigration law jargon, a deportation is actually just one form of expulsion that is a subset of removals, but for the purposes of this paper, the term deportation refers to all forms of expulsion.1 They are grouped into two broad categories: removals and returns.

These enforcement actions were carried out by agents of the Customs and Border Protection (CBP) and ICE. They include aliens who were caught in the act of entering the country illegally and those who were arrested in the interior. These individuals were apprehended by or referred to agents of Border Patrol, ICE or other DHS component agencies, including: ICE’s Enforcement and Removal Operations (ERO); ICE, Homeland Security Investigations (HSI); CBP Office of Field Operation (CBP-OFO) agents at the ports of entry; officers of U.S. Citizenship and Immigration Services (USCIS), which adjudicates applications for green cards, work permits, and citizenship; or local law enforcement officers working in partnership with ICE and Border Patrol.

Deportation totals have fluctuated over the last 30 years, peaking in 1986, 2000, and 2004. The all-time record year was 2000, the last year of the Clinton administration. In 2011, the most recent year for which all ICE and CBP totals have been reported, deportations numbered 715,495. This was the lowest year since 1973, when 585,351 deportations were effected.

Figure 1 also shows that the proportion of removals relative to returns has increased significantly since 1997. A removal is a harsher consequence than return, because it bars the deportee from re-entry for a certain number of years and carries the potential for prison time if the deportee re-enters illegally. Aliens who are granted return are not automatically barred from coming back.

Both forms of deportation are used by both the Border Patrol and ICE. As is shown in Table 3 below, about half of the removal cases attributed to ICE are aliens who were apprehended by the Border Patrol and then turned over to ICE for processing. In addition, the Border Patrol and CBP officers handle some removal cases independently of ICE. As for returns, according to the Border Patrol statistics in Table 1, about 40 percent of returns in 2011 were cases that originated as Border Patrol apprehensions, with the other 60 percent completed by ICE and CBP.

To support the claim of “record” deportations in 2012, the Obama administration and its supporters cite the 409,000 deportations attributed to ICE that year. This is the highest number of removals credited to ICE in a single year; however, the number is higher because it includes the largest number of Border Patrol cases that ever have been transferred to ICE for processing in a single year (see Table 3). It does not reflect an increase in enforcement activity. In past years, these cases would have been handled by the Border Patrol, and counted in total deportations, but not as removals. Removals are at best half the number of total deportations, and do not represent the entire scope of enforcement actions taken by DHS enforcement agencies.

The President himself confirmed this statistical manipulation in 2011, speaking at a roundtable for Hispanic reporters:

“The statistics are actually a little deceptive because what we’ve been doing is, with the stronger border enforcement, we’ve been apprehending folks at the borders and sending them back. That is counted as a deportation, even though they may have only been held for a day or 48 hours, sent back — that’s counted as a deportation.” he said.2

Border Patrol Metrics: More Consequences for Fewer Cases

Table 1 shows the case disposition, or outcome, for each alien apprehended by the Border Patrol in 2012. Two-thirds of the aliens caught that year were processed as a formal removal – either expedited removal or the reinstatement of a prior order of removal. About one-fifth were granted the more lenient treatment of voluntary return. As shown in Table 2 and the accompanying Figure 2, 2012 (the year of “record” deportations) was the first year ever in which a majority of Border Patrol apprehensions resulted in the formal removal of the alien, as opposed to voluntary return. Historically, the vast majority of aliens apprehended by the Border Patrol were allowed to return rather than face removal. Programs that were set up in 2011 to process more border apprehension cases as formal removals were implemented with the stated purpose of deterring repeated crossing attempts, but had the side benefit of boosting ICE’s removal statistics.3

The other significant trend in the Border Patrol case dispositions is that the number of reinstatements of prior removal orders has increased noticeably over the decade, both in absolute numbers and as a share of the total case load. These are cases of individuals who have been caught and removed on multiple occasions. Once a tiny share of the Border Patrol case load, now about one-fourth of those arrested at the border are processed as reinstatements. This could indicate that the rewards of illegal entry still are believed to outweigh the risk of apprehension, or the consequences of apprehension.

Reinstatements are a significant share of ICE’s interior case dispositions as well. In 2012, more than 40,000 of the removals that resulted from an interior arrest were processed as reinstatements, representing about 24 percent of the interior removal case load.4 Clearly, a large number of previously deported aliens have managed to re-enter illegally and carry on for some time before detection, typically after arrest for another crime or traffic offense.

Interior Enforcement Metrics: Doing Less with More

Americans understand that immigration enforcement in the interior is vital to the rule of law, preventing illegal employment, public safety, and national security. Experts estimate that about 60 percent of the approximately 11.7 illegal aliens who are residing here originally entered the country by illegally crossing a land border, and about 40 percent were admitted through an official port of entry and overstayed their visa or authorized admission. Most illegal aliens do not live in the border region; they are dispersed throughout the nation. Besides the seven million or so aliens who are working illegally, there are more than one million removable criminal aliens who are at large in U.S. communities as a result of release from jail or prison, or after having re-entered illegally after deportation.5

To address this problem, Congress has provided ICE with increased funding to enforce immigration laws and remove illegal aliens. In 2008, ICE received $5.6 billion and 17,938 full-time equivalent (FTE) positions. This grew to $5.9 billion and 20,271 FTE positions in 2012 – a growth rate of five percent in funding and 13 percent in staff.6 With additional funding, ICE has been able to launch new technology-based initiatives such as the Secure Communities program, which has dramatically increased its ability to locate illegal aliens who have been arrested and/or booked into jail by local officers for local crimes.

The resource and programmatic enhancements did contribute to increases in interior enforcement from 2008 to 2010, but this activity has declined considerably since 2010. As shown in Table 3 and Figure 3, the number of deportations that resulted from interior enforcement by the two primary agencies of ICE (ERO and HSI) declined by 19 percent from 2011 to 2012, and are projected to fall another 22 percent in 2013.

Table 3 also confirms President Obama’s statement that the primary driver of the removal numbers is Border Patrol arrests, not interior enforcement. In 2012, more than half (52%) of deportations were the result of a Border Patrol arrest. In 2008, only 33 percent of deportations were the result of a Border Patrol arrest; at that time most illegal border crossing cases were processed by the Border Patrol rather than transferred to ICE.

These statistics also reveal that under the Obama administration, the resources of HSI, which is the division of ICE that is responsible for work site enforcement, combating transnational gangs, overstay enforcement, anti-smuggling and trafficking activities, and busting document and identity theft rings, have been diverted to other activities. As a result HSI now makes only a negligible contribution to immigration enforcement. In 2008, HSI arrests produced 17 percent of ICE-initiated deportations; in 2013 they are projected to produce only four percent of ICE-initiated deportations.

ICE Metrics Under “Prosecutorial Discretion”

Table 4 presents some of the key metrics for interior immigration enforcement, which come from internal ICE reports that cover the first 10 months of fiscal years 2012 and 2013 (October 1 to the end of July) – the same time period for each year.

These figures provide a more detailed accounting of the drop-off in enforcement activity by ICE/ERO, the division of ICE that is the primary source of interior enforcement. In addition to processing cases referred by other agencies, ERO is responsible for screening aliens who are in jail or prison after committing local crimes, aliens arrested for local offenses such as drunk driving or other traffic offenses, and aliens who have absconded from immigration proceedings. These activities represent the vast majority of current interior enforcement activity.

The first indicator, departures, is the equivalent of deportations (removals plus returns). As of July 2013, ICE had deported nine percent fewer aliens than at the same point in 2012. As discussed above, about half of these deportation cases are aliens apprehended by the Border Patrol.

Departures of criminals have remained nearly constant, but “non-criminal” removals dropped by about 15 percent. In ICE nomenclature, the term “criminal alien” applies to aliens who have been convicted of a felony or misdemeanor. “Non-criminals” includes those with lesser offenses such as traffic infractions, those who admitted to crimes but were not sentenced to jail, those who were not prosecuted, repeat immigration violators, those who skipped out on immigration hearings,
