WASHINGTON (Reuters) – President Donald Trump suffered a stunning political setback on Friday in a Congress controlled by his own party when Republican leaders pulled legislation to overhaul the U.S. healthcare system, a major 2016 election campaign promise of the president and his allies.

House of Representatives leaders yanked the bill after a rebellion by Republican moderates and the party’s most conservative lawmakers left them short of votes, ensuring that Trump’s first major legislative initiative since taking office on Jan. 20 ended in failure. Democrats were unified against it.

House Republicans had planned a vote on the measure after Trump late on Thursday cut off negotiations with Republicans who had balked at the plan and issued an ultimatum to vote on Friday, win or lose. But desperate lobbying by the White House and Republican House Speaker Paul Ryan was unable to round up the 216 votes needed for passage.

“We learned a lot about loyalty. We learned a lot about the vote-getting process,” Trump told reporters at the White House, although he sought to shift the blame to the Democrats even though his party controls the White House, the House and the Senate.

With Friday’s legislative collapse, Democratic former President Barack Obama’s signature domestic policy achievement, the 2010 Affordable Care Act – known as Obamacare – remains in place despite seven years of Republican promises to dismantle it.

The healthcare failure called into question not only Trump’s ability to get other key parts of his agenda, including tax cuts and a boost in infrastructure spending, through Congress, but the Republican Party’s capacity to govern effectively.

Neither Trump nor Ryan indicated any plans to try to tackle healthcare legislation again anytime soon. Trump said he would turn his attention to getting “big tax cuts” through Congress, another tricky proposition.

Republican supporters said the legislation would achieve their goal of rolling back the government’s “nanny state” role in healthcare. The White House made undoing Obamacare its top priority when Trump took office two months ago.

But the White House and House leaders were unable to come up with a plan that satisfied the clashing interests of moderates and conservatives, despite Trump’s vaunted image as a deal maker.

Amid a chaotic scramble for votes, Ryan, who championed the bill, met with Trump at the White House. Ryan said he recommended that it be withdrawn from the House floor because he did not have the votes to pass it, and Trump agreed.

“We were just probably anywhere from 10 to 15 votes short,” Trump said. “With no Democrat support we couldn’t quite get there.”

Senate Democratic leader Chuck Schumer said the bill failed “because of two traits that have plagued the Trump presidency since he took office: incompetence and broken promises.”

Democrats said the bill would take away medical insurance from millions of Americans and leave the more-than-$3 trillion U.S. healthcare system in disarray.

And some moderate Republicans opposed the bill because of worries that millions of America would be hurt.

“There were things in this bill that I didn’t particularly like,” Trump added, without specifying what those were, but expressed confidence in Ryan’s leadership.

“Perhaps the best thing that could happen is exactly what happened today, because we’ll end up with a truly great healthcare bill in the future after this mess known as Obamacare explodes,” said Trump, who had posted multiple tweets throughout March proclaiming that “Obamacare is imploding” and repeatedly saying that Republicans were coming together to pass the bill.

Friday’s events cast doubt on whether Ryan can get major legislation approved by fractious Republican lawmakers.

“I will not sugarcoat this. This is a disappointing day for us. Doing big things is hard,” Ryan said at a news conference, adding that his fellow Republicans are experiencing what he called “growing pains” transitioning from an opposition party to a governing party.

“Obamacare’s the law of the land,” Ryan added. “We’re going to be living with Obamacare for the foreseeable future.”

Members of the Freedom Caucus, the House’s most conservative members, were instrumental in the bill’s failure, opposing it among other reasons because they considered parts too similar to Obamacare.

Trump said he was disappointed and “a little surprised” with the Freedom Caucus opposition.

The nonpartisan Congressional Budget Office said under the Republican legislation 14 million people would lose medical coverage by next year and more than 24 million would be uninsured in 2026.

News that the bill had been pulled before a final vote was greeted initially with a small sigh of relief by U.S. equity investors, who earlier in the week had been fretful that an outright defeat would damage Trump’s other priorities, such as tax cuts and infrastructure spending.

Benchmark U.S. stock market indexes ended the session mixed after rallying back from session lows following the news. The S&P 500 Index ended fractionally lower, the blue chip Dow Jones Industrial Average slipped about 0.3 percent and the Nasdaq Composite Index rose about 0.2 percent.

Shares of hospital operators finished sharply higher, with the S&P healthcare facilities index up 2.7 percent, while the S&P 500 healthcare sector edged down 0.03 percent. The dollar strengthened modestly on the news, and U.S. Treasury bond yields edged up from session lows.

Trump said he would be “totally open” to working with Democrats on healthcare “when they all become civilized.” House Democratic leader Nancy Pelosi said working to lower prescription drug prices was one area of possible cooperation with Republicans.

Republican Representative Dana Rohrabacher said before the bill was pulled that voting it down would be “neutering Trump” while empowering his opponents.

“You don’t cut the balls off a bull and then expect that he can go out and get the job done,” Rohrabacher told Reuters. “This will emasculate Trump and we can’t do that. … If we bring this down now, Trump will have lost all of his leverage to pass whatever bill it is, whether it’s the tax bill or whatever reforms that he wants.”

Representative Joe Barton of Texas, when asked why his fellow Republicans were so united over the past seven years to dump Obamacare only to fall apart when they actually do something about it, said, “Sometimes you’re playing fantasy football and sometimes you’re in the real game.”

Obamacare boosted the number of Americans with health insurance through mandates on individuals and employers, and income-based subsidies. About 20 million Americans gained insurance coverage through the law.

The House plan would have rescinded a range of taxes created by Obamacare, ended a penalty on people who refuse to obtain health insurance, and ended Obamacare’s income-based subsidies to help people buy insurance while creating less-generous age-based tax credits

It also would have ended Obamacare’s expansion of the Medicaid state-federal insurance program for the poor, cut future federal Medicaid funding and let states impose work requirements on some Medicaid recipients.

House leaders agreed to a series of last-minute changes to try to win over disgruntled conservatives, including ending the Obamacare requirement that insurers cover certain “essential benefits” such as maternity care, mental health services and prescription drug coverage.

WASHINGTON (AP) — House Republicans’ failure to repeal Barack Obama’s health care law deals a serious blow to another big part of President Donald Trump’s agenda: tax reform.

Trump and House Speaker Paul Ryan, R-Wis., say they will soon turn their attention to the first major re-write of the tax code in more than 30 years. But they will have to do it without the momentum of victory on health care.

Just as important, the loss on health care will deprive Republicans of $1 trillion in tax cuts.

The GOP health plan would have repealed nearly $1 trillion in taxes enacted under Obama’s Affordable Care Act. The bill coupled the tax cuts with spending cuts for Medicaid, so it wouldn’t add to the budget deficit.

Without the spending cuts, it will be much harder for Republicans to cut taxes without adding to the federal government’s red ink.

“Yes this does make tax reform more difficult,” said Ryan. “But it does not in any way make it impossible.”

“That just means the Obamacare taxes stay with Obamacare. We’re going to go fix the rest of the tax code,” he added.

House Republicans couldn’t round up enough votes Friday to repeal and replace a law they despise, raising questions about their ability to tackle other tough issues.

“Doing big things is hard,” Ryan conceded as he vowed to press on.

Rep. Jodey Arrington, R-Texas, acknowledged that Friday’s turn of events made him doubtful about the Republicans’ ability to tackle major legislation.

“This was my first big vote and our first big initiative in the line of things to come like tax reform,” said the freshman. “I think this would have given us tremendous momentum and I think this hurts that momentum.”

Rep. Mike Kelly, R-Pa., said, “You always build on your last accomplishment.”

Nevertheless, Treasury Secretary Steven Mnuchin said Friday the administration plans to turn quickly to tax reform with the goal of getting an overhaul approved by Congress by August.

“Health care is a very complicated issue,” Mnuchin said. “In a way, tax reform is a lot simpler.”

Don’t tell that to House Republicans who have been struggling with the issue for years.

The general goal for Republicans is to lower income tax rates for individuals and corporations, and make up the lost revenue by reducing exemptions, deductions and credits.

Overhauling the tax code is hard because every tax break has a constituency. And the biggest tax breaks are among the most popular.

For example, nearly 34 million families claimed the mortgage interest deduction in 2016, reducing their tax bills by $65 billion.

Also, more than 43 million families deducted their state and local income, sales and personal property taxes from their federal taxable income last year. The deduction reduced their federal tax bills by nearly $70 billion.

Mnuchin said he had been overseeing work on the administration’s tax bill for the past two months. He said it would be introduced soon.

Mnuchin said the White House plan would cut individual and corporate tax rates, though he didn’t offer specifics.

House Republicans have released a blueprint that outlines their goals for a tax overhaul. It would lower the top individual income tax rate from 39.6 percent to 33 percent, and reduce the number of tax brackets from seven to three.

The House plan retains the mortgage interest deduction but repeals the deduction for state and local taxes.

On the corporate side, the plan would repeal the 35 percent corporate income tax and replace it with a 20 percent tax on profits from selling imports and domestically produced goods and services consumed in the U.S.

Exports would be exempt from the new tax, called a border adjustment tax.

The new tax has drawn opposition from Republicans in the Senate. Mnuchin would not reveal whether the administration will include the border adjustment tax in the White House proposal. He was speaking at a public interview event with the news site Axios.

Republicans often complained that they couldn’t do a tax overhaul when Obama was president. Now, Republicans control the House, the Senate and the White House, and they see a great opportunity.

They plan to use a complicated Senate rule that would prevent Democrats from blocking the bill. But there’s a catch: Under the rule, the package cannot add to long-term budget deficits.

That means every tax cut has to be offset by a similar tax increase or a spending cut. That’s why the loss on health care was so damaging to the effort to overhaul taxes.

Ryan made this case to fellow House Republicans in his failed effort to gain support for the health plan.

“That was part of the calculation of why we had to take care of health care first,” said Rep. Tom Reed, R-N.Y.

Mike Lee: Senate parliamentarian told me it’s possible to push harder on repealing Obamacare regulations

Sen. Mike Lee, R-Utah, said on Wednesday that the Senate parliamentarian has told him that it may be possible for Republicans to push harder on repealing Obamacare’s regulations than the current House bill, which contradicts the assertion by House leadership that the legislation goes after Obamacare as aggressively as possible under Senate rules.

“What I understood her to be saying is that there’s no reason why an Obamacare repeal bill necessarily could not have provisions repealing the health insurance regulations,” Lee said in an interview with the Washington Examiner, relating a conversation with parliamentarian Elizabeth MacDonough about reconciliation he had on Tuesday.

Lee also said that the parliamentarian told him it wasn’t until very recently, after the unveiling of the House bill, that any Republican even asked her about the possibility of repealing regulations with a simple majority.

With a House vote currently expected on Thursday, Republican leadership is scrambling for votes, trying to stave off a backlash from conservatives that could sink the bill. One of the issues conservatives have raised is that the House bill leaves most of the regulations in place, thus not combatting one of the main complaints about Obamacare – its skyrocketing premiums and limited choice.

Because Republicans don’t have 60 Senate seats to kill a filibuster, they have to pass a healthcare bill through a procedure known as reconciliation, which allows the majority party to pass legislation with a simple majority, assuming it meets a certain set of requirements, including that all provisions be primarily budgetary in nature.

Conservatives such as Lee have argued that Republicans should fight harder to argue that the regulations, which have a clear budgetary impact, can be passed through reconciliation. But House leadership and supporters of the bill have countered that the legislation already goes as far as possible. House Speaker Paul Ryan spokeswoman AshLee Strong, when asked about this by the Washington Examiner last week, said “We’ve worked closely with the Senate to carefully craft the bill to repeal and replace the law to the full extent allowed under the rules.”

But having met with the parliamentarian, who plays a key role in advising the presiding officer of the Senate over what’s in bounds during reconciliation, Lee is more convinced than ever that this is not true.

“One of the things we’ve been told over and over again is the bill was no more aggressive than it has been… in part because of Senate rules,” Lee said. “And the Senate rules are something those defending the bill have repeatedly pointed to in defense of why they wrote it the way they wrote it. The parliamentarian said, there’s not necessarily any reason that would categorically preclude you from doing more, both on the repeal front and the replacement front, all sorts of things are possible.”

He continued, “What matters is how it’s done, how it’s written up. There are ways it’s written up that perhaps make it not subject to passage through reconciliation, but there are other ways you could write it that might make it work.”

On his radio show Wednesday evening, Conservative Review Editor-in-Chief Mark Levin interviewed Senator Mike Lee, R-Utah, about a recent conversation the lawmaker had with the Senate parliamentarian. The discussion: whether or not Obamacare’s regulations could be repealed via reconciliation, which only needs a simply majority to pass.

As previously reported by the Washington Examiner, Lee says that he was told by the parliamentarian (who interprets the rules of the Senate) that, despite claims from House leadership, the current “repeal and replace” legislation could do much more to undo Obamacare’s harmful mandates — if so desired.

 

“I honestly believe that the Republican establishment does not want to repeal the entirety of Obamacare,” Levin said. “I think you have Republican governors … who like the expanded Medicaid, so they’ve already sold out. There’s a lot of that going on.”

As it stands now, the current RINOcare version would repeal several taxes and mandates, but it leaves in place the major regulations that are the primary drivers of America’s skyrocketing health insurance premiums. One of the major reasons that these have been left in place, GOP leaders have said, is that the Byrd Rule in the Senate would prohibit them from repealing them in a budget bill.

But this doesn’t appear to be the case, Sen. Mike Lee says, who says he found out in his meeting with the parliamentarian that nobody from leadership so much as asked how much of Obamacare could be gutted in the budget process.

“She pointed out that it’s not necessarily true what we’ve been told [by leadership],” Lee said.

“I think this is very distressing,” Sen. Lee concluded. “Because a whole lot of congressmen have been told a whole lot of times that this is the best we can do under the Senate’s reconciliation rules. And it’s not true.”

The Preamble to The Bill of Rights

Congress of the United States
begun and held at the City of New-York, on
Wednesday the fourth of March, one thousand seven hundred and eighty nine.

THE Conventions of a number of the States, having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best ensure the beneficent ends of its institution.

RESOLVED by the Senate and House of Representatives of the United States of America, in Congress assembled, two thirds of both Houses concurring, that the following Articles be proposed to the Legislatures of the several States, as amendments to the Constitution of the United States, all, or any of which Articles, when ratified by three fourths of the said Legislatures, to be valid to all intents and purposes, as part of the said Constitution; viz.

ARTICLES in addition to, and Amendment of the Constitution of the United States of America, proposed by Congress, and ratified by the Legislatures of the several States, pursuant to the fifth Article of the original Constitution.

Note: The following text is a transcription of the first ten amendments to the Constitution in their original form. These amendments were ratified December 15, 1791, and form what is known as the “Bill of Rights.”


Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.


Amendment II

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.


Amendment III

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.


Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.


Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.


Amendment VII

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.


Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.


Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.


Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The Spy Satellite Secrets in Hillary’s Emails

These weren’t just ordinary secrets found in Clinton’s private server, but some of the most classified material the U.S. government has.
After months of denials and delaying actions, Hillary Clinton has decided to turn over her private email server to the Department of Justice. As this controversy has grown since the spring, Clinton and her campaign operatives have repeatedly denied that she had placed classified information in her personal email while serving as Secretary of State during President Obama’s first term. (“I am confident that I never sent nor received any information that was classified at the time it was sent and received,” she said last month.) Her team also denied that she would ever hand over her server to investigators. Now both those assertions have been overturned.

Hillary Clinton has little choice but to hand over her server to authorities since it now appears increasingly likely that someone on her staff violated federal laws regarding the handling of classified materials. On August 11, after extensive investigation, the Intelligence Community’s Inspector General reported to Congress that it had found several violations of security policy in Clinton’s personal emails.

Most seriously, the Inspector General assessed that Clinton’s emails included information that was highly classified—yet mislabeled as unclassified. Worse, the information in question should have been classified up to the level of “TOP SECRET//SI//TK//NOFORN,” according to the Inspector General’s report.

You may have seen acronym lists like these on declassified documents before—and glazed over them. This is the arcane language of the cleared cognoscenti so let me explain what this means:

• TOP SECRET, as the name implies, is the highest official classification level in the U.S. government, defined as information whose unauthorized release “could cause exceptionally grave damage to national security or foreign relations.”

• SI refers to Special Intelligence, meaning it is information derived from intercepted communications, which is the business of the National Security Agency, America’s single biggest source of intelligence. They’re the guys who eavesdrop on phone calls, map who’s calling who, and comb through emails. SI is a subset of what the intelligence community calls Sensitive Compartmented Information or SCI. And these materials always require special handling and protection. They are to be kept in a Sensitive Compartmented Information Facility or SCIF, which is a special hardened room that is safe from both physical and electronic intrusion.

• TK refers to Talent Keyhole, which is an IC caveat indicating that the classified material was obtained via satellite.

• NOFORN, as the name implies, means that the materials can only be shown to Americans, not to foreigners.

In short: Information at the “TOP SECRET//SI//TK//NOFORN” level is considered exceptionally highly classified and must be handled with great care under penalty of serious consequences for mishandling. Every person who is cleared and “read on” for access to such information signs reams of paperwork and receives detailed training about how it is to be handled, no exceptions—and what the consequences will be if the rules are not followed.

People found to have willfully mishandled such highly classified information often face severe punishment. Termination of employment, hefty fines, even imprisonment can result.
In the real world, people with high-level clearances are severely punished for willfully violating such rules. At a minimum, those suspected of mishandling things like NSA “signals intelligence”—intercepts calls, emails, and the like—have their clearances suspended pending the outcome of the investigation into their misconduct. Any personal items—computers, electronics—where federal investigators suspect the classified wound up, wrongly, will be impounded and searched. If it has TOP SECRET//SI information on it, “your” computer now belongs to the government, since it is considered classified.

People found to have willfully mishandled such highly classified information often face severe punishment. Termination of employment, hefty fines, even imprisonment can result. Yes, people really do go to jail for mishandling classified materials. Matthew Aid, a writer on intelligence matters, served over a year in prison for mishandling TOPSECRET//SI information from NSA, for example. The well connected tend to avoid jail, however. Sandy Berger and John Deutsch—who both served in high-level positions under President Bill Clinton, did not go to prison for mishandling TOP SECRET intelligence (though Berger got probation and was fined $50,000).

What, then, does all this means for Hillary? There is no doubt that she, or someone on her State Department staff, violated federal law by putting TOP SECRET//SI information on an unclassified system. That it was Hillary’s private, offsite server makes the case even worse from a security viewpoint. Claims that they “didn’t know” such information was highly classified do not hold water and are irrelevant. It strains belief that anybody with clearances didn’t recognize that NSA information, which is loaded with classification markings, was signals intelligence, or SIGINT. It’s possible that the classified information found in Clinton’s email trove wasn’t marked as such. But if that classification notice was omitted, it wasn’t the U.S. intelligence community that took such markings away. Moreover, anybody holding security clearances has already assumed the responsibility for handling it properly.
As Secretary of State, Hillary Clinton had no authority to disseminate IC information on her own, neither could she make it less highly classified (a process termed “downgrading” in the spy trade) without asking IC permission first.

It is a very big deal and less connected people who do this sort of thing ruin their lives, as any IC counterintelligence official can attest. During my NSA time, I saw junior personnel terminated for relatively minor infractions of security regulations. While the U.S. government unquestionably does over-classify items on the policy side, where almost everything in the Defense and State Departments gets some sort of classification stamp, not usually at a high level, intelligence reporting by its very nature is classified. If you don’t want the responsibility of a high-level government position, which inevitably brings with it TOP SECRET//SI access, then don’t accept that burden.

There’s still a lot we don’t know about Hillary’s Emailgate. Exactly how many emails contained TOPSECRET//SI information is unclear. We may never know since thousands of emails were already destroyed by Clinton. Who exactly placed the classified information in emails—it may not have been Hillary Clinton—and how did they access the information in the first place? How many of Hillary’s staffers at Foggy Bottom were also using her personal server?

Underlying all this is the question of why Hillary Clinton decided to employ her own private email and server to handle so much of her official State Department business. This is, to say the least, highly irregular—not to mention a violation of numerous U.S. government rules and regulations—so there had to be a compelling reason to do this. What was it?

The Clinton campaign was concerned enough about the issue to send out an email blast Wednesday afternoon with the subject line: “A note about Hillary Clinton’s emails.”

“You might hear some news over the next few days about Hillary Clinton’s emails,” began the email from Jennifer Palmieri, the communications director for Hillary for America.

“Because you are an important part of this team, we wanted to take a few minutes to talk through the facts—we need your help to make sure they get out there. There’s a lot of misinformation, so bear with us; the truth matters on this.”

Underneath the greeting were several bolded bullet points, including, “Hillary didn’t send any classified materials over email.” There was also a link to a longer, 4,000+ word explanation of why Clinton used a private email address and server in her official capacity as Secretary of State.

The FBI is now on the case and one hopes they will exercise due diligence in their investigation of what may be a serious leak of classified information, made worse by the fact that Clinton’s personal server was wholly unencrypted for three months, leaving it wide open to exploitation by foreign intelligence services.

The number of spy services interested in the communications of the U.S. Secretary of State numbers more than a hundred. Given their technical proficiency, it’s naïve to assume that the Russians and Chinese aren’t among them—a fact that John Kerry, the current secretary, recently admitted.

It’s safe to assume, then, that Moscow and Beijing know what Hillary’s “private” emails as Secretary of State contained. Let’s hope that the American public will someday as well.

The Internet company used by Hillary Clinton to maintain her private server was sued for stealing dozens of phone lines including some which were used by the White House.

Platte River Networks is said to have illegally accessed the master database for all US phone numbers.

It also seized 390 lines in a move that created chaos across the US government.

Among the phone numbers which the company took – which all suddenly stopped working – were lines for White House military support desks, the Department of Defense and the Department of Energy, a lawsuit claims.

Others were the main numbers for major financial institutions, hospitals and the help desk number for T2 Communications, the telecom firm which owned them.

A lawsuit filed on behalf of T2 claims that the mess took 11 days to fix and demands that Platte River pay up $360,000 in compensation.

National Intelligence Community Inspector General Charles McCullough told members of Congress in writing that two of Clinton's emails were so sensitive that it would have been illegal to show them to any foreigner

The claims raise questions about the competence of Platte River, which is based in Denver, Colorado, to handle Mrs Clinton’s highly sensitive personal information while she was Secretary of State.

The Secretary of State’s emails would have been potentially a target for foreign espionage.

Mrs Clinton installed the system at her home in Chappaqua, upstate New York, and did not even have an official email address until the year she left office.

Earlier this week it emerged that she has handed over the server to the FBI which is investigating her and a number of her top aides.

Mrs Clinton acted after the Inspector General for the intelligence community said that he had found four emails that were stored on it were classified and two of those were Top Secret, the highest level of classification.

Until now Mrs Clinton has insisted that none of the emails were classified at the time she sent or received them.

The lawsuit was filed by T2 in November last year and relates to a deal that went through in June.

By that time Mrs Clinton has left her post as Secretary of State; she was in office between 2009 and 2013.

T2 alleges that it had provided 16 phone lines to an insurance broker called Cambridge until they decided to switch providers and signed up with Windstream Communications, who worked with McLeod USA, a local exchange carrier owned by Windstream, and Platte River.

But instead of taking over the 16 lines, T2 claims that the companies asked for 390 more lines in what they called ‘intentional misappropriation’.

T2 alleges that they did this by illegally accessing the database for the Number Portability Administration Centre, the master agency which manages all US phone numbers.

The lawsuit states: ‘Under NPAC regulations, telecommunications providers are only allowed to access the NPAC data base for the exclusive purpose of routing, rating of calls, billing of calls, or performing maintenance in connection with the provision of telecommunications services.

‘Contrary to these NPAC regulations, Defendants accessed the NPAC database to find T2s 390 telephone lines as well as to obtain T2 and its customers’ proprietary network information for use in marketing T2’s lines to their existing and prospective customers.’

The lawsuit describes at length the chaos that resulted when the 390 numbers used by T2 customers suddenly stopped working.

Among the lines which went dead was that for T2’s main number and its help desk, which meant customers were unable to contact the company at a time when they needed it the most.

THE CLINTON DEFENSE 

Hillary’s campaign issued a 4,000-word defense of her on Wednesday, including two separate claims that she never used her private email account to handle classified information. The complete sections are reproduced here, including bolded text in the original:

‘Clinton said she did not use her email to send or receive classified information, but the State Department and two Inspectors General said some of these emails do contain classified information. Was her statement inaccurate?

‘Clinton only used her account for unclassified email. No information in Clinton’s emails was marked classified at the time she sent or received them.

‘When information is reviewed for public release, it is common for information previously unclassified to be upgraded to classified if the State Department or another agency believes its public release could cause potential harm to national security, law enforcement or diplomatic relations.

‘After reviewing a sampling of the 55,000 pages of emails, the Inspectors General have proffered that a small number of emails, which did not contain any classified markings and/or dissemination controls, should have been classified at the time they were sent. The State Department has said it disagrees with this assessment.

‘Clinton hopes the State Department and the agencies involved in the review process will sort out as quickly as possible which of the 55,000 pages of emails are appropriate to share with the public.

‘How did Clinton receive and consume classified information?

‘The Secretary’s office was located in a secure area. Classified information was viewed in hard copy by Clinton while in the office. While on travel, the State Department had rigorous protocols for her and traveling staff to receive and transmit information of all types.

‘A separate, closed email system was used by the State Department for the purpose of handling classified communications, which was designed to prevent such information from being transmitted anywhere other than within that system.’

T2 employees’ numbers also stopped working as did lines for: ‘The Department of Defense, Department of Energy; multiple medical emergency facilities as numbers used for general, pre- and post-surgical contact, and obstetric or gynecological emergencies; Federal Contract Support Desks; White House Military Operations support desks, several financial institution’s main telephone numbers, multiple Denver-based Charter schools’ main and backdoor phone numbers, a US-Based telephone number for IBM China, multiple other information technology companies and their support and internal telephone numbers, as well as T2’s main telephone numbers’.

The lawsuit states that the lines were dead for at least 21 hours and that it took the company at least 10 days to ‘unwind’ the mess and get the numbers back.

Among the legal documents filed in the case is a third party complaint filed by Thomas W. Snyder, a lawyer, on behalf of Windstream and McLeod.

It goes into more detail about Platte River’s role in the deal and claims that the company worked as the sales agent for Windstream in connection with the Cambridge account.

It says that Platte River was responsible for ‘spotting any red flags’ and for ‘resolving any inaccuracies’ with the deal.

The document states: ‘Platte River acted negligently and breached this duty by failing to identify that the 390 additional lines were improper.’

The lawsuit adds a new twist to the row about Mrs Clinton’s email server that is refusing to go away amid intense pressure from Republicans.

Mrs Clinton has said that she exchanged about 60,000 emails over the four years in office on the system, of which half were personal and were deleted.

Mrs Clinton turned over the other half to the Department of State in December last year and they are being reviewed and slowly released to the public.

She has until now refused to hand over the server – which she has wiped clean – but changed her mind when it emerged that some of the emails were classified.

Mr Snyder declined to comment.

Daily Mail Online has reached out to Barbara Wells, a Denver lawyer who represents Platte River, Mrs Clinton’s campaign and T2’s lawyers for comment. We have not received any response.

June 2013 – Hillary’s team shifts control of the email domain to an outside IT contractor in Denver called Platte River Networks, and sends the original server hardware to a data center facility in New Jersey, where it is erased

August 11, 2015 – McCullough revises his statement to Congress, saying that two of the four emails in question should have been classified ‘top secret’ – but were not marked that way – and contained information from signal intercepts and keyhole satellite data; he adds that the other two emails are still being evaluated

The former deputy director of the CIA insisted during a congressional hearing Wednesday that he did not alter the infamous 2012 Benghazi talking points due to political pressure, despite pointed questioning by Rep. Michele Bachmann (R-Minn.).

“The narrative that the attack evolved spontaneously from a protest was a narrative that intelligence community analysts believed,” Mike Morell said. “That turned out to be incorrect. But that is what they believed at the time. So there is no politics there whatsoever.”

“Let me actually give you the facts,” Morell added to Bachmann, before contending the five edits that were made had nothing to do with politics, but instead involved minor stylistic changes and edits to increase accuracy.

Just four days after the attack, the former deputy director of the CIA removed references about threats from extremists tied to Al Qaeda, substituting it by saying that “there are indications extremists participated in the violent demonstrations.”

Bachmann argued such changes were of importance.

“You made significant, substantive changes for the White House,” she said. “Whether it was on behalf, we don’t know. But we know you are the one that made those changes.”

“Ma’am, if you look at the record, what you will see that the changes were fully consistent with what our analysts believed at the time. Period,” the former deputy director replied.

Bachmann said that those on the ground at the time of the attack were ignored and argued that there was an “intentional misleading of the public.”

Morell maintained that the changes he made to the widely debunked 2012 talking points were not for political reasons.

Michael Morell: No cover-up on Benghazi

Former Deputy CIA Director Michael Morell denied Wednesday that there was any cover-up or political influence in messaging after the 2012 attack on the U.S. consulate in Benghazi.

“We did not deliberately downplay the role of terrorists in the Benghazi attack in our analysis or in the talking points,” Morell said during a House Intelligence Committee hearing.

“And neither I, nor anyone else at the agency, deliberately misled anyone in Congress about any aspect of the tragedy in Benghazi,” Morell added.

Morell was deputy director of the agency at the time of the attack on Sept. 11, 2012, on the U.S. consulate in Benghazi, Libya, which led to the deaths of four Americans, including Ambassador Chris Stevens. Both Morell and the agency, as well as the administration, have faced criticism from the right regarding the handling of the attack, including claims that there were political motives behind the framing of the information surrounding the incident.

Many took issue with the talking points following the attack, namely the delay in calling it a terrorist attack carried out by Al Qaeda versus a spontaneous demonstration in protest of an anti-Muslim video.

Chairman Mike Rogers (R-Mich.) said the talking points “did not reflect the best information available” and were used by the administration “to perpetrate a false narrative about the attacks.”

Rogers also asked Morell why he did not say during a November 2012 hearing following the attack why references to Al Qaeda had been taken out of the talking points. Morell said that at the time, he did not know who took them out.

“But to be fair, and, in retrospect, what I wish I would have done, was to say to you, ‘Chairman, I do not know who took Al Qaeda out of the talking points, but you should know that I myself made a number of changes to the points.’ That’s what I should have said. I didn’t,” Morell said.

Morell also said there are things that both he and the agency “should have done differently,” but he dismissed political motivations.

“There are areas where the CIA’s performance and my own performance could have been better, but none of our actions were the result of political influence in the intelligence process. None.”

Morell said he did not know that the talking points would be used by Susan Rice, then U.S. ambassador to the United Nations, in her appearances on the Sunday talk shows shortly following the attacks, which were widely criticized and, many say, cost her the secretary of state position, as she later withdrew her consideration for the spot.

“In fact, I didn’t even know she was going to be on the Sunday shows,” Morell said, adding that no one asked him or the agency to prepare Rice.

Morell said he believed that Rice, who is now national security adviser, would have had the talking points, as well as intelligence information from the days prior. However, he acknowledged that she did not have information sent by the CIA’s station chief on the ground, which concluded that the attack was possibly preplanned.

“Don’t you think that was an important document to get in the hands of someone who is going to brief the country on what was actually happening on the ground?” Rogers asked.

Morell said that the information had not been disseminated outside of the CIA and that at the time, he did not find the arguments that it was a preplanned attack “compelling.” Morell said earlier in the hearing that when the information from the station chief was first sent to analysts, they were “sticking to their judgment” that it was a protest.

“So I believed what my analysts said, that there was a protest. I also believed it to be a terrorist attack. You see, we never, we never saw those two things as mutually exclusive, and so I believed both of those at the same time,” Morell said.

Taking issue with Morell’s testimony was Rep. Devin Nunes.

”The problem is that you have all of these conflicting stories, right?” Nunes (R-Calif.) said to Morell, after questioning him on the sequence of dialogue regarding the attack.

“I read your testimony, and you have an excuse for everything,” Nunes later added. “For everything … which is fine, but when the chairman asks you about when you sat next to Director of National Intelligence [James] Clapper in November of 2012, you don’t have an excuse, you only have an apology.”

Rep. Peter King (R-N.Y.), who has been a vocal critic in the handling of Benghazi, also criticized Morell’s testimony.

“He gave a lot of excuses today and a lot of reasons,” King said Wednesday on Fox News’s “Happening Now.”

“The fact is, to believe him you have to believe, basically, everything is contradictory to the facts,” King said, adding that the administration has not told the truth on Benghazi and that Morell has been part of that process.

“Bottom line is, Susan Rice and the administration told the American people it arose out of a video and demonstration,” King said. “They never mentioned terrorism at all, and that’s the reality. They can’t rewrite history.”

Morell, during his testimony Wednesday, said, “no doubt it was a terrorist attack,” but he said the motivations of those who carried out the attack is unknown, because they have not been caught.

Before the Obama administration gave an inaccurate narrative on national television that the Benghazi attacks grew from an anti-American protest, the CIA’s station chief in Libya pointedly told his superiors in Washington that no such demonstration occurred, documents and interviews with current and former intelligence officials show.

The attack was “not an escalation of protests,” the station chief wrote to then-Deputy CIA Director Michael J. Morell in an email dated Sept. 15, 2012 — a full day before the White House sent Susan E. Rice to several Sunday talk shows to disseminate talking points claiming that the Benghazi attack began as a protest over an anti-Islam video.

That the talking points used by Mrs. Rice, who was then U.S. ambassador to the United Nations, were written by a CIA that ignored the assessment by its own station chief inside Libya, has emerged as one of the major bones of contention in the more than two years of political fireworks and congressional investigations into the Benghazi attack.

What has never been made public is whether Mr. Morell and others at the CIA explicitly shared the station chief’s assessment with the White House or State Department.

Two former intelligence officials have told The Washington Times that this question likely will be answered at a Wednesday hearing of the House Permanent Select Committee on Intelligence during which Mr. Morell is scheduled to give his public testimony.

Mr. Morell, who has since left the CIA, declined to comment on the matter Monday. He now works at Beacon Global Strategies, a Washington insider strategic communications firm.

One former intelligence official close to Mr. Morell told The Times on the condition of anonymity that “the whole question of communication with the station chief will be addressed in his testimony.”

“We’re confident that it will clarify the situation in the minds of many who are asking,” the former official said.

Another former intelligence official told The Times that Mr. Morell did tell the White House and the State Department that the CIA station chief in Libya had concluded that there was no protest but senior Obama administration and CIA officials in Washington ignored the assessment.

Why they ignored it remains a topic of heated debate within the wider intelligence community.

A third source told The Times on Monday that Mr. Morell and other CIA officials in Washington were weighing several pieces of “conflicting information” streaming in about the Benghazi attack as the talking points were being crafted.

“That’s why they ultimately came up with the analysis that they did,” the source said. “The piece that was coming out of Tripoli was important, but it was one piece amid several streams of information.”

One of the former intelligence officials said the Libya station chief’s assessment was being weighed against media reports from the ground in Benghazi that quoted witnesses as saying there had been a protest. Analysts at the CIA, the source said, also were weighing it against reporting by other intelligence divisions, including the National Security Agency.

“The chief of station in Tripoli who was 600 or 700 miles away from the attacks wouldn’t necessarily have the only view of what actually went on in Benghazi,” that former official said.

U.S. Ambassador J. Christopher Stevens and three other Americans were killed in the attack.

While the testimony is expected to focus on Benghazi, the hearing arrives at a time of growing tensions between Congress and the CIA over such matters as the Bush administration’s interrogation rules and mutual charges of spying and illegality between the Senate intelligence committee and the agency.

Lawmakers are likely to press Mr. Morell for a reaction to reports this week that a classified Senate intelligence report has concluded that harsh interrogation methods used in the years after Sept. 11 provided no key evidence in the hunt for Osama bin Laden and that the CIA misled Congress on the matter.

The CIA disputes that conclusion. The Senate panel is expected to vote Thursday on sending the Obama administration a 400-page executive summary of the “enhanced interrogation” report to start a monthslong declassification process.

One of the key issues likely to come up during the House hearing involves what was said during a series of secure teleconferences between CIA officials in Washington and Libya from the time of the attack on Sept. 11, 2012, to the completion of Mrs. Rice’s talking points for dissemination on the Sunday talk shows Sept. 16.

Multiple sources confirmed to The Times on Monday that the station chief’s email to Mr. Morell was written after one of the teleconferences during which senior CIA officials in Washington — Mr. Morell among them — made clear to the Tripoli station chief that they were examining alternative information that suggested there was a protest before the attack.

After the exchange, Mr. Morell signed off on the CIA talking points given to Mrs. Rice promoting what turned out to be the false narrative of a protest. The development ultimately triggered an angry reaction from Republicans, who have long claimed that the Obama administration, with an eye on the November elections, was downplaying the role of terrorists in order to protect the president’s record on counterterrorism.

Documents since released by the White House show that administration officials boasted in internal emails at the time about Mr. Morell’s personal role in editing and rewriting the talking points.

Morell noted that these points were not good and he had taken a heavy editing hand to them,” an Obama administration official wrote Mrs. Rice on the morning of Sept. 15.

What is not clear is whether the email was in any way referring to the conflicting intelligence streams about a protest in Benghazi.

Alternatively, the email notes that Mr. Morell was uncomfortable with an initial draft of the talking points batted back and forth between White House and CIA officials “because they seemed to encourage the reader to infer incorrectly that the CIA had warned about a specific attack” in Benghazi.

During interviews with The Times, several former senior intelligence officials have lamented the whole “talking points” issue, saying the CIA was caught in the middle of the White HouseCongress and the reality on the ground in Benghazi while crafting the points.

The reason the CIA ended up taking the lead on the talking points was because, as news of the attack was breaking around the world, lawmakers on the House intelligence committee were seeking guidance from the agency on how to respond to media questions without revealing classified information.

Specifically, Rep. Mike Rogers, Michigan Republican and the committee chairman, and ranking Democrat C.A. Dutch Ruppersberger of Maryland asked for the guidance.

One former senior intelligence official told The Times that as word circulated through the inner circles of the intelligence community that the CIA was working on the talking points, officials within the Obama administration steered the mission toward crafting something Mrs. Rice could say on national talk shows.

“In essence, the talking points got repurposed,” the former official said. “What it turned into — and I don’t think Michael ever knew this, it’s something to watch for in his testimony this week — was, ‘Let’s hand this thing to the U.N. ambassador and make it what she should say.’”

“That’s a big deal,” the former official said. “It’s one thing to prepare something for lawmakers so they don’t make a mistake or say something inaccurate. It’s quite another matter to have that feed the administration’s then-current, definitive account of what had actually happened in Benghazi.”

“There are a lot of twists and turns in this,” added another former intelligence official. “A lot of it hangs on the fact that the agency thought they were crafting these talking points for Dutch Ruppersberger and Mike Rogers, not the White House.”

Former CIA official accused of misleading lawmakers on Benghazi

Former CIA Deputy Director Michael Morell is facing accusations from Republicans that he misled lawmakers about the Obama administration’s role in crafting the bogus storyline that a protest gone awry was to blame for the deadly Benghazi attack.

Among other discrepancies, Republicans on the Senate Intelligence Committee allege Morell insisted the talking points were sent to the White House for informational purposes, and not for their input — but emails, later released by the administration, showed otherwise.

“We found that there was actual coordination which could influence then — and did influence — what CIA conveyed to the committees about what happened [in Benghazi],” Sen. Richard Burr, R-N.C., told Fox News.

Burr was one of six Republicans who leveled the allegations against Morell, who also served as acting director, in an addendum to a recently released Senate Intelligence Committee report. According to the claims, in late 2012, Morell testified the so-called Benghazi talking points were sent to the White House “for their awareness, not for their coordination.”

The 16-page addendum continues, “No effort was made to correct the record … the Acting Director’s (Morell) testimony perpetuated the myth that the White House played no part in the drafting or editing of the talking points.”

After Morell’s 2012 testimony, committee Republicans say they insisted on reading the raw email traffic in the days leading up to then-Ambassador Susan Rice’s controversial Sunday show appearances, where she linked the attack to a protest. Vice Chairman of the Senate Intelligence Committee Saxby Chambliss, R-Ga., told Fox News in a recent interview that they only got the emails between the CIA, State Department and White House because lawmakers threatened to hold up former White House counterterrorism adviser John Brennan’s confirmation as CIA director.

Once the emails were released, Republican lawmakers say the conflict with Morell’s testimony was clear. Morell, who at the time was CIA Director David Petraeus’ deputy, was at the heart of the process, cutting some 50 percent of the text — and Republicans say White House coordination began at the earliest stages.

Also in late 2012, Morell and Rice met with Sens. Kelly Ayotte, R-N.H.; John McCain, R-Ariz.; and Lindsey Graham, R-S.C. In a statement released at the time, the senators said Morell blamed the FBI for cutting references to Al Qaeda and did so to prevent compromising an ongoing criminal investigation.

“What I found curious is that he did not accept responsibility for changing the talking points. He told me the FBI had done this. I called the FBI. They went ballistic,” Graham said in a recent interview. “Within 24 hours, his statement was changed where he admitted the CIA had done it.”

Graham’s characterization of the meeting was backed up by Ayotte in a recent interview. “I was in that meeting when Susan Rice was with Director Morell when he blamed the FBI for changing those talking points, and you know then we call the FBI, the FBI goes crazy and said ‘we didn’t change the talking points.’ And so you have to wonder particularly now that we know that he may have received that email the day before what was going on.”

The email Ayotte is referring to was sent by the CIA’s top operative on the ground in Libya to Morell, and others at the CIA, one day before Rice’s Sunday show appearances. In the Sept. 15, 2012 email, first publicly documented in the bipartisan section of the Senate Intelligence Committee report, the CIA chief of station in Tripoli reported the attacks were “not/not an escalation of protests.”

One Republican lawmaker, Rep. Frank Wolf of Virginia, is now urging that Morell be recalled to clear up his testimony.

“I think it’s important for the integrity of the oversight,” Wolf said, adding that congressional oversight would be rendered meaningless if Morell were not recalled given the allegations against him.

Wolf, whose resolution to establish a select committee has the backing of a Republican majority in the House, recently wrote a letter to all House Republicans calling for Morell to testify again, potentially in both chambers, to address possible conflicts with previous testimony.

New details, confirmed by Fox News, suggest a similar scenario played out before the House Intelligence committee, chaired by Republican Mike Rogers.

In mid-November 2012, Morell testified along with James Clapper, the nation’s intelligence chief, and Matt Olsen, a senior counterrorism official.
When asked who was responsible for the talking points, first requested by Rogers’ committee, Clapper said he had no idea, while Morell remained silent, according to sources familiar with the testimony.

“If your silence does create a misleading impression even if you don’t have a strict legal obligation to speak up I think as a public official — somebody entrusted, infused with the public trust — you do have an obligation to speak up to make the truth known,”  Tom Dupree, a former deputy assistant attorney general in the Bush administration, said.

Once the talking points emails were released, and Morell’s involvement came into sharper focus, in May 2013 he was asked to testify a second time before the House Intelligence Committee. Sources familiar with Morell’s second testimony say he admitted to changing the talking points, and he offered shifting explanations — from classification issues, to not compromising the FBI investigation — and that exposing the failure of Hillary Clinton’s State Department to act on repeated security warnings seemed unprofessional.

While two sources say Morell insisted the talking points were an afterthought at a White House meeting on Sept. 15 where the text was finalized, an email from White House adviser Ben Rhodes suggests otherwise. Late in the evening of Sept. 14, Rhodes wrote to email addresses at the FBI, the Office of the Director of National Intelligence, CIA, State Department, White House and National Security Staff: “There is a ton of wrong information getting out into the public domain from Congress and people who are not particularly informed … we need to have the capability to correct the record, as there are significant policy and messaging ramifications that would flow from a hardened mis-impression. We can take this up tomorrow morning at deputies.”

Dupree said lawmakers face a choice. “If you’re not getting the full truth in those questions, well then you can either abandon your oversight function or you can call those people back and press them and confront them with the facts.”

Since retiring from the CIA, Morell has taken on high-profile assignments for the administration, including the NSA review panel and the President’s Intelligence Advisory Board. He is now a paid TV commentator for CBS News, has a book deal, and works for Beacon Global Strategies, whose founder Philippe Reines has been described by the New York Times magazine as Clinton’s “principal gatekeeper.”

In an email to Fox News on Feb. 13, Morell said: “I stand behind what I have said to you and testified to Congress about the talking point issue. Neither the Agency, the analysts, nor I cooked the books in any way.”

When asked specific questions about Republican allegations he provided misleading testimony, Morell did not answer the questions, instead referring Fox News to the CIA public affairs office.

Spokesman Dean Boyd provided this statement to Fox News: “As we have said multiple times, the talking points on Benghazi were written, upon a request from Congress, so that members of Congress could say something preliminary and in an unclassified forum about the attacks. As former CIA Deputy Director Michael Morell has stated publicly time and again, the talking points were never meant to be definitive and, in fact, the points themselves noted that the initial assessment may change. He has addressed his role in the talking points numerous times. We don’t have anything further to add to the large body of detail on the talking points that is already in the public domain.”

Mike Morell: Man in the Middle of Benghazi Talking Points Scandal

Recent reporting has centered on CIA deputy director Mike Morell as a key player in critical and misleading changes made to the Obama Administration’s Benghazi talking points. The CIA talking points were cited by U.N. Ambassador Susan Rice on five different national Sunday talk shows on September 16, five days after the attack. Administration officials from President Obama and Secretary of State Hillary Clinton on down cited them. The initial draft of the talking points was produced by the CIA’s Office of Terrorism Analysis on September 14 at 11:15 a.m. A demonstration was mentioned, but so was al-Qaeda and Ansar-al-Sharia involvement. It referred to the CIA’s “numerous pieces on the threat of extremists linked to al Qaeda in Benghazi and eastern Libya.” National Security Council (NSC) staff edited the talking points on the 14th. But it was the State Department that had the most reservations. Hillary Clinton’s spokeswoman (and now Assistant Secretary of State for Europe) Victoria Nuland did not like the CIA’s draft—nor did her “building leadership,” as she said in an e-mail on September 14 at 9:24 p.m. She wrote to the NSC staff:

Why do we want Hill to start fingering Ansar Al Sharia, when we aren’t doing that ourselves until we have the investigation results…and the penultimate point could be abused by Members to beat the State Department for not paying attention to Agency warnings so why do we want to feed that?… Concerned.

The next morning, September 15, at 9.45 a.m., Morell produced what became essentially thefinal version of the talking points (Senate report, p. 51), removing references to known terrorist groups and identifying a non-existing demonstration as the cause. Outrageously, the official talking points contradicted the known facts. According to the recent report by the Senate Select Committee on Intelligence (p. 33), on September 15, the CIA’s Chief of Station in Tripoli reported in an e-mail that the Benghazi attacks were “not an escalation of protests.” Morrell completely ignored it. Below are the finalized talking points:

  • “The currently available information suggests that the demonstrations in Benghazi were spontaneously inspired by the protests at the US Embassy in Cairo and evolved into a direct assault against the U.S. diplomatic post in Benghazi and subsequently its annex. There are indications that extremists participated in the violent demonstrations.”
  • “The assessment may change as additional information is collected and analyzed and as currently available information continues to be evaluated.”
  • “The investigation is on-going, and the US Government is working with the Libyan authorities to bring to justice those responsible for the deaths of US citizens.”

The text was not only misleading but so pathetic that then-CIA director David Petraeus commented, “Frankly, I’d just as soon not use this.” However, it was the State Department and the White House that were calling to shots, and Mike Morell played along.

Michael Joseph Morell (born September 4, 1958) was the deputy director of the Central Intelligence Agency and served as acting director twice in 2011 and from 2012 to 2013. Morell retired from his post on August 9, 2013, to devote more time to his family and to pursue other professional opportunities. As of 2014, Morell is CBS News‘ Senior Security Correspondent.

Early life and education

Morell is a native of Cuyahoga FallsOhio. His formal education includes a B.A. in economics from the University of Akron and an M.A.in economics from Georgetown University.[1] He joined the CIA in 1980. He was chief of the CIA‘s division on AsiaPacific and Latin America.[2]

Career

Most of Morell’s work in the agency was devoted to Asian projects.[1] He also managed the staff that produced the Presidential Daily Briefings for President George W. Bush. Morell was Bush’s briefer during the September 11, 2001 attacks, and has been quoted as saying, “I would bet every dollar I have that it’s al Qaeda.” Furthermore, Morell was a trusted asset to President Barack H. Obama II in the Osama bin Laden raid on May 2, 2011.[1][2] Before his 2010 nomination as deputy director, Morell served as director for intelligence, a position he had held since 2008. Before that, he served as the CIA’s first associate deputy director from 2006 to 2008.

In May 2010, Morell was sworn in as the deputy director of the CIA, succeeding Stephen Kappes.[3] From July 1, 2011, to September 6, 2011, he served his first stint as acting director of the Central Intelligence Agency, following the appointment of Leon Panetta assecretary of defense.[4] On November 9, 2012, Morell once again became acting director after David Petraeus, following the sex scandal.[5] Obama chose John Brennan, who was confirmed by the U.S. Senate by 12 to 3 vote on March 5, 2013.[6]

Morell announced his retirement from the CIA on June 12, 2013.[7]

Cover-up

A cover-up is an attempt, whether successful or not, to conceal evidence of wrongdoing, error, incompetence or other embarrassing information. In a passive cover-up information is simply not provided; in an active cover-up deception is used.

The expression is usually applied to people in positions of authority who abuse their power to avoid or silence criticism or to deflect guilt of wrongdoing. Those who initiate a cover up (or their allies) may be responsible for a misdeed, a breach of trust or duty or a crime.

While the terms are often used interchangeably, cover-up involves withholding incriminatory evidence, while whitewash involves releasing misleading evidence.

Below is a letter from a group of about 700 retired U.S. military special operations veterans to the House of Representatives, urging Congress to establish a committee to investigate the Benghazi attack. Colonel Dick Brauer, founder of the group Special Operations Speaks explained the effort on Fox and Friends this morning.

To: Members of The U.S. House of Representatives

Subject: The Benghazi attacks on 9/11/ 2012

The undersigned are a representative group of some 700 retired Military Special Operations professionals who spent the majority of their careers

preparing for and executing myriad operations to rescue or recover detained or threatened fellow Americans. In fact, many of us participated in both the Vietnam era POW rescue effort, The Son Tay Raid, as well as Operation Eagle Claw, the failed rescue attempt in April of 1980 in Iran, so we have been at this for many years and have a deep passion for seeking the truth about what happened during the national tragedy in Benghazi.

The purpose of this letter is to encourage all members of the US House of Representatives to support H.Res. 36, which will create a House Select Committee on the Terrorist Attack in Benghazi. It is essential that a full accounting of the events of September 11, 2012, be provided and that the American public be fully informed regarding this egregious terrorist attack on US diplomatic personnel and facilities. We owe that truth to the American people and the families of the fallen.

It appears that many of the facts and details surrounding the terrorist attack which resulted in four American deaths and an undetermined number of American casualties have not yet been ascertained by previous hearings and inquiries. Additional information is now slowly surfacing in the media, which makes a comprehensive bipartisan inquiry an imperative. Many questions have not been answered thus far. The House Select Committee should address, at a minimum, the following questions:

1. Why was there no military response to the events in Benghazi?

a. Were military assets in the region available? If not, why not?

b. If so, were they alerted?

c. Were assets deployed to any location in preparation for a rescue or recovery attempt?

d. Was military assistance requested by the Department of State? If so, what type?

e. Were any US Army/Naval/USMC assets available to support the US diplomats in Benghazi during the attack?

f. What, if any, recommendations for military action were made by DOD and the US Africa Command?

2. What, if any, non-military assistance was provided during the attack?

3. How many US personnel were injured in Benghazi?

4. Why have the survivors of the attack not been questioned?

5. Where are the survivors?

6. Who was in the White House Situation Room (WHSR) during the entire 8-hour period of the attacks, and was a senior US military officer present?

7. Where were Leon Panetta and General Martin Dempsey during the crisis, and what inputs and recommendations did they make?

8. Where were Tom Donilon, the National Security Advisor, Denis McDonough, his deputy, Valerie Jarrett and John Brennan during the attacks, and what (if any) recommendations or decisions did any of them make?

9. Why were F-16 fighter aircraft based in Aviano, Italy (less than two hours away) never considered a viable option for disruption (if not dispersal) of the attackers until “boots on the ground” (troop support–General Dempsey’s words) arrived?

10. Were any strike aircraft (such as an AC-130 gunship) in the area or possibly overhead that would cause former SEAL Tyrone Woods to laser-designate his attacker’s position and call for gunship fire support, thereby revealing his own location that led to his death?

11. Who gave the order to “STAND DOWN” that was heard repeatedly during the attacks?

12. What threat warnings existed before the attack, and what were the DOD and DOS responses to those warnings? What data (which will reveal exact timelines and command decisions) is contained within the various SITREPS, records, logs, videos and recordings maintained by the myriad of DOD, Intelligence Community and State Department Command Centers that were monitoring the events in Benghazi as they unfolded?

13. Why did the Commander-in Chief and Secretary of State never once check in during the night to find out the status of the crisis situation in Benghazi?

14. What was the nature of Ambassador Stevens’ business in Benghazi at the time of the attack?

15. What guidance has been provided to survivors and family members since the time of the attack, and who issued that guidance?

16. Why are so many agencies now requiring their personnel that were involved in or have access to information regarding the events that took place in Benghazi sign Non-Disclosure Agreements?

This was the most severe attack on American diplomatic facilities and personnel since the attacks on the US Embassies in Tanzania and Kenya in 1998. Thus far, it appears that there has been no serious effort to determine critical details of this attack. This is inexcusable and demands immediate attention by the Congress. Congress must show some leadership and provide answers to the public as to what actually occurred in Benghazi. Americans have a right to demand a full accounting on this issue.

A longstanding American ethos was breached during the terrorist attack in Benghazi. America failed to provide adequate security to personnel deployed into harm’s way and then failed to respond when they were viciously attacked. Clearly, this is unacceptable and requires accountability. America has always held to the notion that no American will be left behind and that every effort will be made to respond when US personnel are threatened. Given our backgrounds, we are concerned that this sends a very negative message to future military and diplomatic personnel who may be deployed into dangerous environments. That message is that they will be left to their own devices when attacked. That is an unacceptable message.

The House Select Committee should focus on getting a detailed account of the events in Benghazi as soon as possible. H. Res. 36 will provide a structure for the conduct of a thorough inquiry of Benghazi and should be convened immediately.

We ask that you fulfill your responsibilities to the American people and take appropriate action regarding Benghazi. With over sixty members of the US House of Representatives calling for this Select Committee already, it seems that the time is right to take appropriate action on Benghazi.

CBS Devotes Two Straight Days of Coverage to ‘Possible Cover-Up’ on Benghazi; ABC, NBC Out to Lunch

CBS used its Sunday evening and Monday morning newscasts to keep the spotlight on the question of a “possible cover-up” surrounding the terrorist attack on the U.S. consulate in Benghazi. Jeff Glor led CBS Evening News with the scoop from earlier in the day on Face the Nation – that a “career U.S. diplomat is raising new questions” about the Obama administration’s claim that the attack spontaneously erupted in response to an early protest in Egypt.

Monday’s CBS This Morning also aired a report on this latest development on the September 11, 2012 attack. Meanwhile, ABC and NBC have yet to pick up on the veteran diplomat’s allegations, despite the fact that he is set to testify publicly to Congress on the issue on Wednesday.

Glor teased a report from correspondent David Martin by trumpeting that “a new witness emerges – a senior U.S. diplomat contradicts the White House and seems to support Republican claims of a cover-up over the attack in Benghazi.” Martin first outlined what Rep. Darrell Issa had revealed earlier in the day on Face the Nation:

DAVID MARTIN: Greg Hicks – at the time, the number-two diplomat at the U.S. embassy in Tripoli…directly contradicts administration claims that at first, the attack was thought to be nothing more than a demonstration growing out of a similar protest that day in Cairo. ‘I thought it was a terrorist attack from the get-go. I think everybody in the mission thought it was a terrorist attack from the beginning.’

The CBS journalist continued with a clip of U.N. Ambassador Susan Rice’s now-discredited assertion about the terror attack, which she made on several Sunday morning talk shows on September 16, 2012. He also noted that Rep. Issa “pointed out Rice’s statement directly contradicted the president of Libya, who had appeared just before her on ‘Face the Nation’.”

Near the end of the segment, Martin underlined a key assertion from Hicks – that the diplomat “told committee investigators Rice’s words were an insult to the president of Libya, and may have hobbled efforts to capture those responsible for the attack. ‘I firmly believe that the reason it took us so long to get the FBI to Benghazi is because of those Sunday talk shows.'”

Hours later, on Monday’s CBS This Morning, correspondent Margaret Brennan rehashed much of what her colleague had reported the previous evening. Brennan also highlighted another statement from Hicks on Rice’s apparent slight to the Libyan president:

MARGARET BRENNAN: Hicks said that the public contradiction was a personal insult to the Libyan president, because Ambassador Rice – quote, ‘basically said that the president of Libya is either a liar or doesn’t know what he’s talking about. My jaw hit the floor as I watched this.’ He believes that’s why the Libyan government refused to allow the FBI access to the crime scene for several weeks.

Brennan had also singled out the FBI’s pursuit of three persons of interest who could provide information on the attack in Benghazi during a report on Thursday’s CBS This Morning, and touted how “what happened that night is still the topic of debate in Washington“. ABC devoted a news brief to the FBI investigation on Wednesday’s World News, while NBC punted on covering it.

The Benghazi talking points: What’s known and unknown

New information is raising questions about the development of the administration’s talking points on the deadly attack on the diplomatic facility in Benghazi, Libya, which left four Americans, including the ambassador, dead.

Readers may recall that The Fact Checker concluded that there was something rather odd about U.N. Ambassador Susan E. Rice’s comments on the Sunday news shows shortly after the attack. Rice said the attack “began spontaneously” because of a reaction to a protest in Cairo sparked by a “hateful video,” and there was no indication it was “premeditated or preplanned.”

We awarded her Two Pinocchios the morning after she appeared on the shows, concluding that “the publicly available evidence stands in stark contrast to Rice’s talking points.”

The White House at the time sharply disputed that conclusion, but over time that column has held up rather well. (In an interview with congressional investigators that was released over the weekend, deputy chief of mission Gregory Hicks said “my jaw hit the floor as I watched this.”) Some readers have suggested we should boost the Pinocchio rating for Rice’s comments. Still, it is clear Rice was simply mouthing the words given to her. The bigger mystery now is who was involved in writing — and rewriting — the talking points.

The talking points have become important because, in the midst of President Obama’s reelection campaign, for a number of days they helped focus the journalistic narrative on an anti-Islam video — and away from a preplanned attack. As we noted in our timeline of administration statements, it took two weeks for the White House to formally acknowledge that Obama believed the attack was terrorism.

We also have awarded Pinocchios to Republicans for claims about Benghazi. In this column, as a reader service, we outline below some of the new disclosures, contained in a report by House Republicans and an article in the Weekly Standard, and contrast the new information with previous statements made by administration officials.

The House report contains references to specific e-mails between administration officials; the Weekly Standard then identifies who wrote the e-mails as well as various drafts of the talking points. As far as we know, the administration has not publicly denied the information about the talking points contained in the GOP report or the article.

The key new disclosure is that senior levels of the White House and State Department were closely involved in the rewriting of the talking points. Previously, Obama administration officials had strongly suggested that the talking points were developed almost exclusively by intelligence officials.

Here is White House spokesman Jay Carney speaking to reporters on Nov. 28, 2012:

“Ambassador Rice was using unclassified talking points that were developed by the intelligence community and provided not just to her, not just to the executive branch, but to the legislative branch. And they represented the best assessment by our intelligence professionals about what had happened in Benghazi at that time.”

“The White House and the State Department have made clear that the single adjustment that was made to those talking points by either of those two — of these two institutions were changing the word ‘consulate’ to ‘diplomatic facility,’ because ‘consulate’ was inaccurate. Those talking points originated from the intelligence community. They reflect the IC’s best assessments of what they thought had happened.”

Note how Carney stressed that this was “developed by the intelligence community” and the “talking points originated from the intelligence community.”

In a narrow sense, this is correct. Both the House report and the Weekly Standard say the CIA created — or “originated” — the first draft of the talking points. The version as of Friday morning, Sept. 14, 2012, was rather detailed, saying that “Islamic extremists with ties to al-Qaeda participated in the attack” and mentioning the militant group Ansar al-Sharia. It also referred to previous attacks against foreign interests and the possibility there had been surveillance of the U.S. facility.

But a senior State Department official — identified by the Weekly Standard as State Department spokeswoman Victoria Nuland — objected to this draft after being asked to clear the talking points for release. The CIA made some changes, but apparently that was not enough. Nuland said in an e-mail disclosed by the House report that the edits did not “resolve all my issues or those of my building leadership” and that the State Department’s leadership “was consulting with [National Security Staff.]”

(Update: Reading between the lines, part of State’s concern appears to be inconsistency in messaging. Nuland, as State Department spokesman, had been constrained from saying much about the attack at the podium, and now the CIA was proposing to give lawmakers much more information than the administration had released. Moreover, from State’s perspective, the original draft contained references to CIA’s warnings about the security environment, which appeared designed to deflect attention from the agency’s substantial role in Benghazi.)

Minutes later, a White House official (said to be Ben Rhodes, the deputy national security adviser for strategic communications), who was part of the email group receiving Nuland’s message, e-mailed to say that the State Department’s concerns would need to be addressed and the issue would be resolved at a meeting the next day at the White House.

The result, after the meeting, was a wholesale rewriting of the talking points. The House report says “the actual edits, including deleting all references to al-Qaeda, were made by a current high-ranking CIA official,” which the Weekly Standard identifies as Deputy Director Mike Morell.

Oddly, in November, three GOP senators released a statement saying that Morell had told them that the references to al-Qaeda had been removed by the FBI — but then six hours later the CIA contacted them to say Morell “misspoke” and instead the CIA had actually made those deletions. His own apparent role appears not to have been mentioned.

Morell may have had his hand on the pen, but the available evidence suggests that White House and State Department had much more involvement than the “single adjustment” of changing the word “consulate” to “diplomatic facility,” as Carney asserted.

The biggest unknown is whether the “building leadership” in the State Department that objected to the initial talking points included anyone on Clinton’s immediate staff. (One presumes that nit-picking over wording would not have risen to Clinton’s level.) There is no indication that Nuland had any role in crafting or even discussing the talking points after her email on Friday evening, nor is it clear from the email portions that have been released whether she had actually consulted with other officials before objecting to the draft.

Nuland is expected to be nominated for assistant secretary for European affairs. Lawmakers are likely to question her closely on this point during her confirmation hearings.

Clinton, during her testimony before the Senate and the House in January, made the following comments about the development of the talking points. She also stressed it was an “intelligence product” and said she was not involved in the “talking points process” and she “personally” was not focused on them — odd locutions that leave open the possibility that she was aware of the internal debate at the time.

“I would say that I personally was not focused on talking points. I was focused on keeping our people safe.”

“I wasn’t involved in the talking points process…. As I understand it, as I’ve been told, it was a typical interagency process where staff, including from the State Department, all participated, to try to come up with whatever was going to be made publicly available, and it was an intelligence product.”

“I was not involved in the so-called talking points process. My understanding is it was a typical process, trying to get to the best information available. It was an intelligence product.”

“The evidence was being sifted and analyzed by the intelligence community, which is why the intelligence community was the principal decider about what went into talking points. And there was also the added problem of nobody wanting to say things that would undermine the investigation.”

As more information emerges, we will continue to track how the administration’s statements hold up over time and whether more Pinocchio ratings are appropriate.

Dereliction of duty is a specific offense under United States Code Title 10,892. Article 92 and applies to all branches of the US military. A service member who is derelict has willfully refused to perform his duties (or follow a given order) or has incapacitated himself in such a way that he cannot perform his duties. Such incapacitation includes the person falling asleep while on duty requiring wakefulness, his getting drunk or otherwise intoxicated and consequently being unable to perform his duties, or his vacating his post contrary to regulations.

TIMELINE OF EVENTS: HOW THE RESCUE OPERATION UNFOLDED

  • Four Americans, including Ambassador Chris Stevens, were killed in a six-hour, commando-style attack on the US Mission on September 11
  • CIA Director David Petraeus did not attend the ceremony when the coffins arrived back in US to conceal the CIA operation in eastern Libya
  • Al Qaeda in North Africa and Islamist militia Ansar al-Sharia were implicated
  • Timeline of CIA involvement blows open the dramatic sequence of events, revealing that of 30 American officials there, 23 were with the CIA

9.40pm – CIA officials in ‘The Annex’ get a distress call from the consulate saying they are under attack.

10.05pm – Armed only with handguns, team of about six CIA security officers leave their base for the public diplomatic mission compound.

10.30pm – With bullets whistling overhead, the CIA team move into the compound after unsuccessfully trying to get heavy weapons and help from local Libyan allies.

11.10pm – A Defense Department drone, which had been on an unrelated mission some distance away, arrived in Benghazi to help officials on the ground gather information.

11.30pm – U.S. personnel who had been working or staying at the mission all accounted for, except for Ambassador Stevens.

11.40pm – Driving back to the secure base, the evacuees come under further fire.

12am – The installation itself comes under fire from small arms and rocket-propelled grenades.

12am – A CIA security team based in Tripoli, which included two U.S. military officers, lands at Benghazi airport and begins plotting how to locate the missing ambassador.

1am – The patchy attacks on the base begin to die down after 90 minutes of fierce fighting.

4am – The reinforcements from Tripoli take a convoy of vehicles to the CIA base to prepare for evacuation.

4.30am – a fresh round of mortar attacks is launched on the base, killing two U.S. security officers.

5.30 – A heavily armed Libyan military unit arrive at the CIA base to help evacuate the compound of U.S. personnel to the Benghazi airport.

From 6am – Roughly 30 Americans, as well as the bodies of Stevens and the other three Americans killed during the attacks, were loaded on planes and flown out of the city, several U.S. officials said.

Pentagon releases official timeline of Benghazi attack

The Pentagon released Friday an hour-by-hour timeline of the September 11 assault on the U.S. Consulate in Benghazi, Libya, highlighting when Defense Secretary Leon Panetta and senior commanders were informed of the attack and when decisions were made to move forces to assist. The release comes as the Obama administration is facing increasing questions over its response to the attack.Obama administration continues explanations on Benghazi decision-makingSeptember 11 (Events are listed using the time in Benghazi)

9:42 p.m. — Armed men begin their assault on the U.S. Consulate.

9:59 p.m. — A surveillance drone is directed to fly over the U.S. compound, but it is unarmed.

10:32 p.m. — The Office of the Secretary Defense and the Joint Staff are notified of the attack by the National Military Command Center at the Pentagon. “The information is quickly passed to Secretary Panetta and General Dempsey.”

11 p.m. — Panetta and Chairman of the Joint Chiefs of Staff Gen. Martin Dempsey meet with President Obama at the White House where they discuss the unfolding situation and how to respond. The meeting had been previously scheduled.

11:10 p.m. — The surveillance drone arrives over the Benghazi facility.

11:30 p.m. — All surviving U.S. personnel are evacuated from the consulate. U.S. Ambassador Chris Stevens and State Department computer expert Sean Smith were killed in the initial assault.

September 12

Midnight to 2 a.m. — Panetta and other senior leaders discuss possible options for further violence if it were to break out. Panetta gives verbal orders for Marine anti-terrorist teams from Rota, Spain, to prepare to deploy to Tripoli and Benghazi. Panetta also orders a special operations force team training in Croatia and an additional special operations force team in the United States to prepare to deploy to a staging base in southern Italy.

1:30 a.m. — A six-man security team from the U.S. Embassy in Tripoli arrives in Benghazi.

2:39 a.m. to 2:53 a.m. — The National Military Command Center gives formal authorization for the deployment of the two special operations force teams from Croatia and the United States.

5:15 a.m. — Attackers launch assault on a second U.S. facility in Benghazi. Two former U.S. Navy SEALs acting as security contractors are killed. They are identified as Tyrone Woods and Glen Doherty.

6:05 a.m. — A C-17 aircraft in Germany is told to prepare to deploy to Libya to evacuate the consulate personnel.

7:40 a.m. — The first wave of Americans are evacuated to Tripoli via airplane.

10 a.m. — A second group, including those killed in the attack, are flown to Tripoli.

2:15 p.m. — The C-17 departs from Germany for the flight to Tripoli.

7:17 p.m. — The C-17 leaves Tripoli with the American consulate personnel and the bodies of Stevens, Smith, Woods and Doherty.

7:57 p.m. — The U.S. special operations force team based in Croatia arrives at a staging base in Italy.

8:56 p.m. — One of the Marine anti-terrorist teams from Spain arrives in Tripoli.

“…The top two Defense Department officials were sharply challenged by lawmakers Thursday on their insistent claims that nothing more could have been done to save the four Americans who were killed in the Sept. 11 terror attack in Benghazi.

Secretary Leon Panetta and Joint Chiefs Chairman Gen. Martin Dempsey were peppered with questions from Republican senators during a hearing before the Senate Armed Services Committee. The officials claimed military aircraft and other assets were too far away to get to the scene in time, and suggested armed aircraft like F16s could have done more harm than good in a chaotic situation. The senators, though, pressed the officials for a fuller explanation on why military assets were not deployed to rescue Americans under attack that night — in what will likely be their last chance to question the outgoing Defense secretary.

Sen. John McCain, R-Ariz., disputed testimony that the difficulty in dispatching assets to the scene was “a problem of distance and time.” He suggested the “light footprint” in the region and a failure to respond to threats left the military ill-prepared.

“For you to testify that our posture would not allow a rapid response — our posture was not there because we didn’t take into account the threats to that consulate, and that’s why four Americans died,” he said. “We could have placed forces there. We could have had aircraft and other capacity a short distance away.”

He continued: “No forces arrived there until well after these murders took place.”

Dempsey acknowledged having gotten word of a warning from the U.S. consulate about being unable to withstand a sustained attack, but said the military never got a request for support from the State Department.

“So it’s the State Department’s fault?” McCain asked, curtly.

“I’m not blaming the State Department,” Dempsey said.

McCain responded: “Who would you blame?”

Dempsey went on to claim that several U.S. posts were facing significant threats, though McCain said none so much as Benghazi.

Shortly afterward, Sen. Lindsey Graham, R-S.C., pressed Panetta again on why no forces were deployed until after the attack was over. Dempsey and Panetta said they talked to President Obama one time that night, but Graham questioned why there weren’t subsequent follow-up conversations.

“It lasted almost eight hours … did the president show any curiosity?” Graham asked.

Panetta said there was “no question” Obama “was concerned about American lives.”

“With all due respect,” Graham responded, “I don’t believe that’s a credible statement if he never called and asked you, ‘are we helping these people?'”

The secretary’s testimony on Benghazi was long-sought by Republican lawmakers. After then-Secretary of State Hillary Clinton testified last month, Graham had demanded that Panetta be brought before the Senate — threatening to hold up the nomination of his prospective replacement Chuck Hagel over the issue.

Committee Chairman Carl Levin, D-Mich., announced last week that Panetta would testify.

Responding to long-running questions about whether more military assets could have been dispatched to protect those under fire in Libya on Sept. 11, Panetta in his opening statement claimed there simply wasn’t enough time to do more.

“There was not enough time given the speed of the attack for armed military assets to respond,” he said before the Senate Armed Services Committee. “We were not dealing with a prolonged or continuous assault which could have been brought to an end by a U.S. military response. … Time, distance, the lack of an adequate warning, events that moved very quickly on the ground prevented a more immediate response.”

Still, he said the Pentagon “spared no effort … to save American lives.”

Panetta was testifying in what may be his final public appearance on Capitol Hill as he prepares to leave the department.

Panetta, in his testimony, detailed the military response on the day and night of the attack.

As Fox News has previously reported, he said an unarmed, unmanned drone was positioned overhead the Benghazi compound.

But he said armed aircraft like AC-130 gunships would have taken too long to get there — “at least nine to 12 hours if not more to deploy.”

“This was, pure and simple … a problem of distance and time,” he said.

Panetta said he also directed that a Marine Fleet Antiterrorism Security Team stationed in Spain prepare to deploy in addition to a second FAST platoon; a special operations force in Central Europe prepare to deploy to a staging base in Southern Europe; and a special ops force in the U.S. similarly prepare to deploy to Southern Europe.

As for what was happening in Libya, he claimed the “quickest response” was the Tripoli-based team of six people which was sent to Benghazi.

“Members of this team, along with others at the annex facility, provided emergency medical assistance and supported the evacuation of all personnel. Only 12 hours after the attacks had begun, all remaining U.S. government personnel had been safely evacuated from Benghazi,” he said.

Since the September assault, some have questioned whether enough was done to protect those at the consulate and CIA annex in Benghazi. Four Americans, including U.S. Ambassador Chris Stevens, were killed that night.

There have been questions about the perceived delays CIA officials — stationed in Benghazi — encountered that night and their frustration that air support was not sent from nearby Sigonella air base. In recent weeks, Fox News has learned that the rescue unit that left Tripoli was told that air support would be above when they landed in Benghazi, but it wasn’t. …”

An Incriminating Timeline: Obama Administration and Libya (VIDEO)

The latest incriminating information on the U.S. consulate attack in Benghazi, Libya indicates that the State Department turned down a request for additional security from concerned U.S. embassy staff.

New evidence shows there were security threats in Libya in the months prior to the deadly September 11 attack that killed U.S. Ambassador Christopher Stevens and three other Americans. Despite these threats, the State Department left its personnel there to fend for themselves.

And when the terrorist attack did take place, the Obama Administration peddled the ridiculous story that an offensive, amateurish, anti-Islam YouTube video was to blame in order to avoid characterizing the murders of four Americans as terrorism.

On October 2, a letter was sent to Secretary of State Hillary Clinton from House Oversight and Government Reform Committee Chairman Darrell Issa (R–CA) and Jason Chaffetz (R–UT), Chairman of the National Security, Homeland Defense and Foreign Operations Subcommittee. The letter detailed 13 known security threats against U.S. facilities in Libya in the six months prior to September 11.

On October 10, the committee will hold a hearing on events in Libya and seek answers from the State Department. Also on October 10, The Heritage Foundation will host a public panel discussion on the events in Libya titled, “Intelligence and Security Failure: Attacks in Benghazi and Across the Middle East Reveal Ongoing Threat of Terrorism.”

To help our readers follow the path to tragedy on September 11 and its aftermath, below is a chronology of key events:

April 6: IED thrown over the fence of the U.S. Consulate in Benghazi.

April 11: Gun battle erupts between armed groups two-and-a-half miles from the U.S. Consulate, including rocket-propelled grenades.

April 27: Two South African contractors are kidnapped by armed men, released unharmed.

May 1: Deputy Commander of U.S. Embassy Tripoli’s Local Guard Force is carjacked, beaten, and detained by armed youth.

May 1: British Embassy in Tripoli is attacked by a violent mob and set on fire. Other NATO embassies attacked as well.

May 3: The State Department declines a request from personnel concerned about security at the U.S. Embassy in Libya for a DC-3 plane to take them around the country.

May 22: Two rocket-propelled grenades are fired at the Benghazi office of the International Committee of the Red Cross, less than 1 mile from the U.S. Consulate.

June 6: A large IED destroys part of the security perimeter of the U.S. Consulate in Benghazi. Creates hole “big enough for 40 men to go through.”

June 10: A car carrying the British ambassador is attacked in Tripoli. Two bodyguards injured.

Late June: The building of the International Red Cross attacked again and closed down, leaving the U.S. flag as the only international one still flying in Benghazi, an obvious target.

August 6: Armed assailants carjack a vehicle with diplomatic plates operated by U.S. personnel.

September 8: A local security officer in Benghazi warns American officials about deteriorating security.

September 11: Protesters attack the U.S. Cairo embassy. U.S. Embassy releases statement and tweets sympathizing with Muslim protesters/attackers.

September 11: U.S. Consulate in Benghazi, Libya is attacked, Ambassador Chris Stevens and three other Americans are killed.

September 12: Secretary Clinton and President Obama issue statements condemning both the video and the attacks.

September 12: U.S. intelligence agencies have enough evidence to conclude a terrorist attack was involved.

September 13: Press Secretary Jay Carney condemns video and violence at a news conference.

September 14: Carney denies Administration had “actionable intelligence indicating that an attack on the U.S. mission in Benghazi was planned or imminent.”

September 14: The bodies of slain Americans return to Andrews Air Force Base. President Obama again blames the YouTube video.

September 16: U.N. Ambassador Susan Rice appears on Sunday talk shows and says the attacks were provoked by the video, exclusively.

September 16: Libyan President Mohamed Magarief says, “no doubt that this [attack] was preplanned, predetermined.”

September 17: State Department spokeswoman Victoria Nuland refuses to call attacks an act of terror.

September 19: CNN reports having found Ambassador Stevens’s diary, which indicates concern about security threats in Benghazi.

September 19: Director of the National Counterterrorism Center Matthew Olsen tells Congress the attack in Libya was “terrorism.”

September 20: Carney tries to back up Olsen, says it was “self-evident that what happened in Benghazi was a terrorist attack.”

September 20: Obama refuses to call attack terrorism, citing insufficient information.

September 21: Secretary of State Clinton, at meeting with Pakistani Foreign Minister, says, “What happened in Benghazi was a terrorist attack.”

September 25: On ABC’s “The View,” Obama says, “we don’t have all of the information yet so we are still gathering.”

September 25: To the U.N. assembly, Obama blames “A crude and disgusting video sparked outrage throughout the Muslim world.”

September 26: Libya’s Magarief on the “Today” show says, “It was a preplanned act of terrorism directed against American citizens.”

September 26: Published reports show U.S. Intel agencies and the Obama Administration knew within 24 hours that al-Qaeda affiliated terrorist were involved.

September 27: Innocence of Muslims filmmaker Mark Basseley Youseff (aka Nakoula Basseley Nakoula) is arrested and denied bail on the charges of “probation violation.”

September 28: Director of National Intelligence James R. Clapper, Jr., issues a statement backing the Obama Administration’s changing story about the Libyan attack. Says facts are evolving.

October 2: Carney declines to comment on reported requests from diplomats in Libya for additional security, citing the State Department’s internal investigation.

Mistakes were made, Obama lies, people die. What difference does it make?

Retired Major General Bob Scales believes, the White House should have taken action to go after the terrorists in Benghazi on 9/11/12. TWO U.S. drones were flying overhead, giving the White House all the info needed, which made the “fog of war” a minimum concern, and help for the CIA agents and U.S. Ambassador was less than 2 hours away. The siege lasted for 7 hours, making a rescue very possible for at least 2 CIA agents. Repeated calls for help, by the CIA agents, only met with a “request denied” with each call.
